SUBJECT: IN THE MATTER OF IDAHO POWER COMPANY'S APPLICATION FOR
APPROVAL OF ENERGY SERVICES AGREEMENT AND TARIFF
SCHEDULE 35 TO PROVIDE ELECTRIC SERVICE TO CHOBANI,LLC;
CASE NO. IPC-E-26-19.
On June 8,2026,Idaho Power Company("Company")applied to the Idaho Public Utilities
Commission("Commission")requesting: (1)approval of an energy sales agreement("ESA")with
Chobani, LLC ("Chobani"); (2) approval of rates in, and proposed changes to, the Company's
tariff Schedule 35; (3) approval of particular accounting treatment of energy sales under the ESA;
(4) approval of an interim arrangement between the Company and Chobani where the Company
would provide electric service under the rates and charges of tariff Schedule 19 until the
Commission issued a final order on the ESA; and (5) a final Commission order by March 1, 2027
("Application"). Application at 13.
On July 21, 2026, the Commission issued a Notice of Application and Notice of
Intervention Deadline, setting a deadline for interested parties to file a petition to intervene. Order
No. 37101. The Commission granted intervention to Idaho Irrigation Pumpers Association, Inc.
and Micron Technology, Inc. Order Nos. 37119 and 37137.
STAFF RECOMMENDATION
Commission Staff("Staff') recommends that the Commission issue a Notice of Modified
Procedure, establishing a December 17,2026,public,intervenor,and Staff comment deadline, and
a January 28, 2027, reply comment deadline.
