Subject:Notice of Probable Violation,Report#L202603—Lower Valley Energy
Dear Mr.Brooks:
Here is the response to the probable violations identified during the Damage Prevention Procedural Audit of Lower
Valley Energy's Idaho natural gas facilities,conducted August 3,2026(Report#L202603).
Probable Violation(s):
1.Damage Prevention Program requirements were not fully met(49 CFR§ 192.614).
2.LVE's Operation and Maintenance Manual did not require enrollment in an Idaho one-number
notification service,and LVE was not enrolled until August 3,2026(Idaho Code§ 55-2206).
Response: LVE recognizes each probable violation.
1.LVE enrolled in the Idaho one-call one-number notification service on August 3,2026,bringing our
excavation notification process into compliance with 49 CFR§ 192.614.
We continue to work on making sure our damage prevention and one-call enrollment records are accurate and
complete going forward.
