BCL-T-26-01 LLC'S NOTICE TO VOLUNTARILY ) RELINQUISH ITS CPCN ) ORDER NO. 37126 On March 12, 2026, Broadvox-CLEC, LLC ("Company") submitted to the Idaho Public Utilities Commission("Commission") a Notice to Voluntarily Relinquish its Certificate of Public Convenience and Necessity ("CPCN")No. 484 ("Notice"), which was issued by the Commission in Order No. 30820, and authorized the Company to provide telecommunication services, including local exchange and interexchange services, in the State of Idaho. The Company represented it does not have any customers, and thus it did not believe customer notice was necessary.Notice at 1. The Company did not request a waiver to the customer notice requirement. STAFF COMMENTS Commission Staff("Staff') reviewed the Notice, Order No. 30820, and CPCN No. 484, and at the Commission's Decision Meeting on August 4,2026,presented a Decision Memorandum recommending the Commission acknowledge the Company's relinquishment of CPCN No. 484 and that the Company was discontinuing all of its telecommunication services in the State of Idaho. Staff Decision Memorandum at 1. Staff also recommended that the Commission waive the requirement for customer notice.Id. Finally, Staff recommended that the Commission cancel, and remove from the Commission's website, the Company's tariff and pricelist.Id. COMMISSION FINDINGS AND DECISION The Commission has jurisdiction over the Notice and the issues in this case under Title 62 of the Idaho Code, including Idaho Code § 62-612.A telephone corporation intending to withdraw or stop providing basic local exchange or message telecommunication service cannot do so unless there is at least one alternative telephone corporation providing services to customers in the area. Idaho Code § 62-612(l)(b). Further, a telephone corporation must file a notice of the withdrawal or discontinuance with the Commission. Idaho Code § 62-612(2). The telephone corporation is required to publish the notice of its withdrawal or discontinuance in a newspaper circulated in the applicable local exchange area.Id. ORDER NO. 37126 1 The Commission has reviewed the record in this case and Staff s Comments. Based on our review,we find that the Company may withdraw or discontinue providing basic local exchange or message telecommunication services. Further, we find that the Company properly notified the Commission of its intent to withdraw or stop providing services. Because the Company does not have any customers, the Commission finds that a customer notice in a newspaper in the local exchange area is unnecessary. Accordingly, we acknowledge the Company's relinquishment of CPCN No. 484 and that the Company is discontinuing all of its telecommunication services in the State of Idaho. Following the service date of this Order, the Commission will cancel and remove from the Commission's website the Company's tariff and pricelist. ORDER IT IS HEREBY ORDERED that the Commission acknowledges that the Company is relinquishing CPCN No. 484 and that the Company is discontinuing its telecommunication services in the State of Idaho. IT IS FURTHER ORDERED that because the Company does not have any customers, customer notice is not necessary. IT IS FURTHER ORDERED that following the service date of this Order,the Commission shall cancel and remove from the Commission's website the Company's tariff and pricelist. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within 21 days of the service date of this Order regarding any matter decided in this Order.Within seven days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.Idaho Code §§ 61-626 and 62-619.
