("Micron"or"Intervenor"),pursuant to the Commission's Rules of Procedure 71 through 74,1 hereby petitions the Idaho Public Utilities Commission ("Commission") for leave to intervene and to appear and participate in this proceeding as a party, and as grounds therefore states: 1. Micron receives electric utility services from Idaho Power Company ("Idaho Power"or the"Company")as a Special Contract customer,taking service under Schedules 26 and 28. Micron is one of Idaho Power's largest customers. 3. In this case,Idaho Power seeks Commission approval of an energy sales agreement ("ESA")between Idaho Power and Chobani, LLC ("Chobani") and Tariff Schedule 35. 4. Micron has a direct and substantial interest in this proceeding for two reasons.2 First, as a large customer, Micron has an interest in ensuring Idaho Power's electric rates are just, reasonable, and nondiscriminatory and that the Chobani ESA will not result in unreasonable rate impacts to other customers. PETITION TO INTERVENE IPC-E-26-19 Commission's decisions regarding ESAs in general as such decisions could be applied in the future across other Idaho Power ESAs. Micron, therefore, has a "direct and substantial interest" in this proceeding.3 5. Micron intends to participate herein as a party and, if necessary, to file comments, introduce evidence, cross-examine witnesses, call and examine witnesses, and be heard in argument. The nature and quantity of evidence Micron will introduce is dependent upon the nature and effect of other evidence in this proceeding. 6. Granting Micron's Petition to Intervene will not unduly broaden the issues,nor will it prejudice any party to this case. 7. Without the opportunity to intervene, Micron would be without adequate means to participate in this proceeding that will have a material impact on its electric service. WHEREFORE,Micron Technology,Inc.respectfully requests that the Commission grant its Petition to Intervene in this proceeding and to appear and participate in all matters as may be necessary and appropriate; and, if necessary, to present evidence, call and examine witnesses, present arguments and to otherwise fully participate in this proceeding.
