SWS-W-25-02 UTILITIES,LLC'S APPLICATION FOR ) AUTHORITY TO INCREASE ITS RATES ) ORDER NO. 37090 AND CHARGES FOR WATER SERVICE IN ) THE STATE OF IDAHO ) On December 1, 2025, CDS Stoneridge Utilities, LLC ("Company") applied to the Idaho Public Utilities Commission ("Commission") requesting authorization to increase its rates and charges for water service such that the Company would experience a 43% increase in revenues ("Application"). The Company requested an effective date of February 1, 2026. On December 31, 2025, the Commission issued a Notice of Application, Notice of Intervention Deadline establishing a 21-day intervention period, and Notice of Suspension suspending the Company's proposed effective date. Order No. 36896. The Commission granted intervention to Randolph Lee Garrison,pro se, and Stoneridge Property Owners Association, Inc. (collectively"Intervenors"). Order No. 36922. On March 11,2026,the Commission issued notice that the Application would be processed under Modified Procedure with established comment deadlines. Commission Staff("Staff') and both Intervenors filed comments. The Commission also received 28 public comments. On April 20,2026,the Commission issued notice that it would hold an in-person customer hearing regarding the Company's Application. On May 20, 2026, the date of the Commission's customer hearing and prior to the Company reply comment deadline, the Company filed notice that it was withdrawing the Application. Because there was insufficient time to cancel the customer hearing after the Company's notice, the hearing took place as scheduled. At the Commission's June 23, 2026, Decision Meeting, Staff presented a Decision Memorandum recommending that the Commission issue an order acknowledging the Company's withdrawal of the Application and clarifying uncertainty with the Company's Certificate of Public Convenience and Necessity ("CPCN"). Having reviewed the record, we issue this order (1) acknowledging the Company's withdrawal of the Application and (2) directing that all future filings and communications ORDER NO. 37090 1 accurately identify J.D. Resort,Inc. as the certificated utility or,if the Company intends to operate under another legal entity, requiring the Company file an application requesting to amend CPCN No. 395 to reflect the appropriate entity. COMMISSION FINDINGS AND DECISION The Commission has jurisdiction over this matter and the issues in this case under Title 61 of the Idaho Code. The Commission regulates "public utilities," including "water corporations" that serve the public, or some portion thereof, for compensation.Idaho Code §§ 61-125, -129, and -501. Under Rule 68 of the Commission's Rules of Procedure, a notice of withdrawal is effective 14 days after filing unless otherwise ordered by the Commission. Because we did not issue any orders regarding the Company's May 20, 2026, Notice of Withdrawal of Application within 14 days, the withdrawal is effective as of June 3, 2026. We note that the Commission expended considerable state resources in arranging and conducting a customer hearing on the same day the Company filed notice of its withdrawal. Many Company customers also took the time to attend the hearing. For future reference, we encourage the Company to be more cognizant of the procedural schedule of its proceedings before the Commission and the impact the timing of its filings might have on the the parties to the case, its customers, and other interested persons. The Commission approved the transfer of CPCN No. 395 from CDS Stoneridge Utilities, LLC to J.D. Resort, Inc. on August 2, 2019. Order No. 34391. Inadvertently, we did not issue the Third Amended Certificate No. 395, which formally transferred the CPCN to J.D. Resort, Inc., until June 25, 2026. Future Company filings and communications shall accurately identify J.D. Resort, Inc. as the certificated utility or, if the Company intends to operate under another legal entity, the Company shall file an application requesting to amend CPCN No. 395 to reflect the appropriate entity. ORDER IT IS HEREBY ORDERED that the Company's Application is withdrawn, effective June 3, 2026. IT IS FURTHER ORDERED that all future Company filings and communications shall accurately identify J.D. Resort, Inc. as the certificated utility or, if the Company intends to operate under another legal entity, the Company shall file an application requesting to amend CPCN No. 395 to reflect the appropriate entity. Any person interested in this Order may petition for reconsideration within 21 days of the service date of this Order regarding any matter decided in this Order.Within seven days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.Idaho Code § 61-626.
