MELANSON DEPUTY ATTORNEY GENERAL DATE: JUNE 30, 2026 SUBJECT: IN THE MATTER OF SOUTHSHORE 2 WATER COMPANY LLC'S APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY; CASE NO. SSW-W-26-01. On February 12, 2026, Southshore 2 Water Company LLC ("Company") applied to the Idaho Public Utilities Commission ("Commission") requesting a Certificate of Public Convenience and Necessity ("CPCN"), to operate as a public utility in the State of Idaho ("Application"). On May 29, 2026, the Commission issued a Final Order granting the Company's request for a CPCN. Order No. 37053. In addition to granting the Company's request for a CPCN, the Commission directed Commission Staff("Staff') to open a separate docket to evaluate whether the Company's interim rates are fair,just and reasonable. Order No. 37053 at 11. On June 15,2026,the Company applied to the Commission requesting authority to increase its rates and charges for water service in the State of Idaho ("Application"). Case No. SSW-W-26- 02. STAFF RECOMMENDATION Commission Staff has reviewed the Company's Application and believes that Staff can implement the Commission's directive in Order No. 37053 to evaluate whether the Company's interim rates are fair,just, and reasonable in Case No. SSW-W-26-02. In addition to the fair,just, and reasonable evaluation, Staff anticipates that Case No. SSW-W-26-02 will provide Staff with the opportunity to investigate, evaluate, and provide recommendations on the Company's interim and proposed rates at a deeper level of detail than directed by the Commission in Order No. 37053. DECISION MEMORANDUM 1 Accordingly, Staff recommends the Commission issue an order directing Staff to carry out the Commission's directives in Order No. 37053 to evaluate whether the Company's interim rates are fair,just, and reasonable in Case No. SSW-W-26-02.
