PETITION FOR RECONSIDERATION AND MOTION FOR LATE FILING WAIVER
OF BRENDA CHARLES
Comes now the Complainant, Brenda Charles, and respectfully petitions the
Commission for reconsideration of Final Order No. 37057 under IDAPA 31.01.01.331.
Complainant simultaneously moves for a waiver of the 21-day filing deadline for good
cause under IDAPA 31.01.01.013, as Complainant is a low-income single parent on a
fixed Social Security income managing a severe medical crisis involving a pregnant
household dependent reliant on life-support equipment. The grounds for this petition
are as follows:
1. Illegal Shutoff During Active Commission Investigation & Property Damage
The record must be expanded to include a severe violation of Commission rules by
Idaho Power. On October 10, 2025, while an active investigation was openly being
conducted by the Idaho Public Utilities Commission regarding this dispute, Idaho
Power illegally and remotely disconnected Complainant's power supply.
This abrupt remote disconnection caused an immediate electrical surge that
permanently fried the motherboard of Complainant's air conditioning unit. Prior to this
remote shutoff, the AC unit was operating in excellent condition. This illegal action
has stripped the household of vital climate control, directly endangering
Complainant's pregnant daughter who requires a temperature-controlled environment
to safely operate her medical CPAP machine.
2. The Commission Erred in Dismissing the UCRR 206 Claim (Third-Party Debt)
The Commission ruled that the Complainant did not provide sufficient factual context
regarding IDAPA 31.21.01.206. Complainant clarifies that Idaho Power transferred a
third-party debt of$7,270.67 from 2060 West Shy Creek PI. to Complainant's
account. Complainant was never an owner of that account, never signed a contract,
and never authorized identity usage. The account owner was an ex-partner who
unilaterally listed Complainant as a dependent on a previous assistance application.
Holding an uncontracted dependent liable for a third party's separate debt violates
UCRR 206.

3. Omission of WICAP Energy Assistance Credits
Complainant was approved in September for $1,200 in energy assistance through
WICAP. Idaho Power failed to properly process or credit this mandatory assistance to
the account, creating an artificial and inaccurate arrearage.
4. Direct Violation of Medical Protections (UCRR 308)
Complainant's household includes a pregnant daughter reliant on a CPAP machine.
Idaho Power representatives are actively refusing to accept or provide the necessary
medical certification paperwork under IDAPA 31.21.01.308, creating an immediate
threat to life-support equipment in extreme summer temperatures.
RELIEF REQUESTED
Complainant requests that the Commission: (1) Accept this petition for good cause;
(2) Order an immediate stay of disconnection; (3) Order Idaho Power to remove the
$7,270.67 third-party debt; and (4) Require Idaho Power to repair or replace the air
conditioning motherboard destroyed by their illegal October 10, 2025 shutoff.
