IPC-E-24-44. BACKGROUND On December 6, 2024, Idaho Power Company ("Company") filed an application ("Application") with the Idaho Public Utilities Commission ("Commission") requesting an order approving the Special Contract for electric service between the Company and Micron Idaho Semiconductor Manufacturing (Triton) LLC ("Micron"), for Micron's new memory manufacturing fabrication complex ("Micron FAB"), and approving the rates proposed in tariff Schedule 28. On May 8, 2026, the Commission approved the Application and Special Contract with modifications in Order No. 37039. The Commission ordered the Company to submit a compliance filing including a revised Schedule 28 updating: (1) the initial Energy Charge to $0.04084 per kilowatt hour ("kWh"), consistent with the revised workpaper reflecting the 2025 Marginal Cost Update-Single Run Method approved in Case No. IPC-E-25-17; and (2) the Contract Demand charge to $3.12 per kilowatt ("kW") and the Billing Demand charge to $20.25 per kW to reflect the 2025 GRC Settlement Stipulation CCOS. Order No. 37039. Additionally, the Commission ordered the Company to modify the ESA contract terms related to the marginal cost-based Energy Charges and the Minimum Monthly Billing Demand, revising Section 5.5(b) and Section 7.2 DECISION MEMORANDUM - 1 - JUNE 16, 2026 consistent with the amendments proposed by Micron at the hearing in Micron Exhibits 304 and 305. Id. On June 2,2026,the Company filed a revised Schedule 28 tariff with updated rates and an executed First Amendment to the Micron FAB special contract incorporating revisions to Section 5.5(b) and Section 7.2. STAFF REVIEW Staff reviewed the revised Schedule 28 tariff and the First Amendment to the Micron FAB special contract. Staff believes the revised tariff and the First Amendment satisfies the Commission's requirements to submit a compliance filing as ordered in Order No. 37039. The Company updated the Energy Charge,Contract Demand Charge, and Billing Demand Charge to the values ordered by the Commission in Order No. 37039. In addition, the Company updated the Daily Excess Demand Charge to be the same value as all other Special Contract's Daily Excess Demand Charge approved by the Commission in Case No. IPC-E-25-16. Commission Order No. 37039 did not specifically address updating the Daily Excess Demand Charge in Schedule 28, but Staff believes it is appropriate to update this value to reflect changes that have occurred since the Company's original Application and to be consistent with the rate change approved by the Commission in Case No. IPC-E-25-16. The First Amendment to the Micron Fab special contract includes the revised Section 5.5(b)and Section 7.2 language consistent with the amendments proposed by Micron at the hearing in Micron Exhibits 304 and 305. The First Amendment also included a provision that it become effective as of the Commission's final approval of the First Amendment. Staff believes the First Amendment is reasonable and satisfies the Commission's requirements provided in Order No. 37039. STAFF RECOMMENDATION Staff recommends that the Commission approve Schedule 28 and the First Amendment as filed.
