NOTICE OF INTENT TO PROMULGATE RULES— NEGOTIATED RULEMAKING
AUTHORITY.In compliance with Sections 67-5220(1)and 67-5220(2),Idaho Code,notice is hereby given that this
agency intends to promulgate rules and desires public comment and input prior to initiating formal rulemaking
procedures. This negotiated rulemaking action is authorized pursuant to Sections 61-303, 61-315, 61-501, 61-502,
61-503,61-507,and 61-523,Idaho Code,with regard to valuation and service.

DESCRIPTIVE SUMMARY AND STATEMENT OF PURPOSE: In accordance with Idaho Code Section 67-
5292, the Commission is reviewing IDAPA 31.36.01 to assess whether the content of the rule chapter is still
necessary. As part of negotiated rulemaking the Commission will explore repealing this rule chapter because it
appears to be no longer necessary given that the definition of a"small water company" is outdated, and the rule's
presumption that all system assets are contributed capital may no longer align with how some systems are financed
and operated today. Repealing this chapter will allow the Commission to address capital-investment issues on a
case-by-case basis through existing rate-recovery filings, ensuring more accurate and appropriate regulatory
treatment.
