SUBJECT: NEGOTIATED RULEMAKING: RULES OF PROCEDURE OF THE
IDAHO PUBLIC UTILITIES COMMISSION
In accordance with Idaho Code Section 67-5292, the Commission is reviewing IDAPA
31.01.01 — Rules of Procedure of the Idaho Public Utilities Commission to assess whether the
content of the rule chapter is still necessary.As part of negotiated rulemaking process,Commission
Staff ("Staff') will explore updating the Commission's Rules of Procedure to reflect modern
practices, including the transition to online filing systems and other necessary cleanup. The Staff
is reviewing these rules to simplify and streamline them while ensuring they remain practical and
straightforward to apply. Potential revisions include updating outdated statutory references,
aligning hearing procedures with current administrative-hearing processes,modernizing filing and
service requirements, updating contact information, and removing obsolete provisions. These
updates are intended to maintain clarity and support existing Commission processes without
expanding the rules' scope or altering their underlying structure.
Staff has already submitted the necessary paperwork to DFM to issue a Notice of
Negotiated Rulemaking, which will be held on June 11, 2026.
STAFF RECOMMENDATION
Staff recommends the Commission direct Staff to open a new docket designated as RUL-
U-26-01 for purposes of rulemaking.
