AMENDED FORMAL COMPLAINT (RULE 54)
Pursuant to the Commission's Interlocutory Order No. 37017 and Rule 54
(IDAPA 31.01.01.054) , I, Brenda Charles, hereby submit this Amended
Formal Complaint against Idaho Power Company ("the Company".)
I. STATEMENT OF FACTS
On June 8, 2025, the Company transferred a balance of approximately
$6,908.00 to my personal account. On June 10, 2025, an additional amount
was transferred, resulting in a total disputed balance of $7,270.67.
These charges are associated with utility service provided to 2060 West
Shy Creek P1., Nampa, ID.
I am not the financially responsible party for this account. I never
signed a contract or assumed liability for this address. While a former
partner resided there, I was never the account owner. The Company failed
to provide any notice regarding these balance changes or the intent to
transfer this debt to my name until the actions occurred on June 8 and
June 10, 2025.
II. LEGAL BASIS (VIOLATIONS)
The Company's actions violate the following Commission rules:
1. IDAPA 31.21.01.206 (Transfer of Bills) : The Company failed to
follow specific procedures required to move a third-party debt to my
account without my legal consent.
2. IDAPA 31.21.01.308 (Financial Responsibility) : The Company is
holding me liable for charges for which I did not contract, violating
standards for determining customer liability.
III. RELIEF REQUESTED (PRAYER FOR RELIEF)
I respectfully request that the Commission:
1. Order Idaho Power to immediately remove the transferred
charges of $7,270.67 from my account.
2. Issue a formal finding that I am not the financially
responsible party for the debts associated with 2060 West Shy Creek P1.,
Nampa, ID.
3. Protect my current utility service from disconnection related
to these disputed amounts while this case is being resolved.
