Comment: "To the Idaho Public Utilities Commission,
I am writing in my capacity as President of the Southshore 2 Homeowners Association
regarding the Application for a Certificate of Public Convenience and Necessity submitted
by Ryan Martin on February 12, 2026, concerning the water system serving Southshore
Subdivision No. 2.
The Applicant's filing includes the recorded Final Plat for Southshore Subdivision No. 2.
That plat expressly states that the community water system is owned and maintained by
the Southshore 2 Homeowners Association.
The HOA was formed prior to the 2017 and 2018 transfers of the water right referenced in
the application materials.The HOA did not receive notice of those transfers at the time they
occurred. Given the language contained in the recorded plat and the sequence of
subsequent transfers, unresolved questions remain concerning ownership and lawful
control of the system.
The HOA has communicated its concerns to relevant agencies and is currently represented
by legal counsel actively working to address and resolve these ownership and governance
issues.
Because ownership and control of the system remain disputed, we respectfully request
that the Commission refrain from authorizing or approving the pending application until
these matters are clarified.
If a more formal filing, including a Petition to Intervene submitted through counsel, is
required to preserve the HOA's position in this proceeding, please advise and we will
coordinate accordingly.
