LOLL DEPUTY ATTORNEY GENERAL DATE: JANUARY 20, 2026 SUBJECT: IN THE MATTER OF INTERMOUNTAIN SEWER AND WATER CORPORATION'S APPLICATION TO CHARGE AN INTERIM RATE FOR SERVICE; CASE NO. ISW-W-25-02. On May 29, 2025, Intermountain Sewer and Water, Corp. ("Company") applied to the Idaho Public Utilities Commission ("Commission") requesting a Certificate of Public Convenience and Necessity ("CPCN") authorizing it to provide water service in and around the Mayfield Spring Planned Community in Elmore County, Idaho. The Company also requested authority from the Commission to charge an interim rate for service,as determined by a calculation proposed by the Company("Application"). The Commission bifurcated the Company's requests and ordered the creation of a separate docket to consider the Company's request to charge an interim rate for service and the reliability of the Company's water system, contingent upon the resolution of the Company's request for a CPCN. Order Nos. 36688, 36772. On September 8, 2025, this case was opened. On September 29,2025,the Commission issued an order approving the Company's request for a CPCN in Case No. ISW-W-25-01. Order No. 36772. On October 23, 2025, the Commission issued the Company's CPCN. Certificate No. 562. STAFF RECOMMENDATION Commission Staff("Staff') recommends the Commission issue a Notice of Application and Notice of Modified Procedure, establishing a February 25, 2026, public comment deadline, and a March 18, 2026, Company reply comment deadline.
