LOLL DEPUTY ATTORNEY GENERAL DATE: JANUARY 20, 2026 SUBJECT: IN THE MATTER OF IDAHO POWER COMPANY'S APPLICATION FOR APPROVAL OF THE SECOND AMENDMENT OF THE FIRM ENERGY SALES AGREEMENT BETWEEN IDAHO POWER COMPANY AND CYCLE HORSESHOE BEND WIND,LLC; CASE NO. IPC-E-26-01. On January 12, 2026, Idaho Power Company ("Company") applied to the Idaho Public Utilities Commission ("Commission") requesting the Commission issue an order approving the Second Amendment to the Firm Energy Sales Agreement ("FESA") between the Company and Cycle Horseshoe Bend Wind, LLC ("Application"). STAFF RECOMMENDATION Commission Staff("Staff') recommends the Commission issue a Notice of Application and Notice of Modified Procedure, establishing a public comment deadline seven (7) days after service of the order and a reply comment deadline fourteen (14) days after service of the order. The Company requested the Commission process the Application without issuing a Notice of Application or Notice of Modified Procedure. See Application at 4. The Company represented that the FESA will reach the end of its full term in February 2026,making approval of the requested amendment a time-sensitive issue.Id. The Company requested the Commission issue an order"as soon as possible."Id. Staff believes that the Commission can accommodate the Company's practical timing concerns without forgoing a process for interested persons to file written comments by exercising its discretion to establish an abbreviated modified procedure timeline.
