Box 500 Boise, ID 83701-0500 Telephone: (208) 608-7950 Facsimile: (208) 384-4454 Email: BoiseCityAttomey(ic,cityofboise.org mr rg ant&cityofboise.org Attorney for Intervenor BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF CAPITOL WATER Case No. CAP-W-25-02 CORPORATION'S APPLICATION FOR COMMENTS OF THE CITY AUTHORITY TO INCREASE ITS RATES AND OF BOISE CITY CHARGES FOR WATER SERVICE IN THE STATE OF IDAHO COMES NOW, the city of Boise City ("City") and submits these formal comments on the application submitted by Capitol Water Corporation ("Capitol Water") for an increase of customer rates for water service by 6.004%,pursuant to Rule 203 of the Commission's Rules of Procedure, IDAPA 31.01.01.203, and pursuant to the Notice of Modified Procedure, Order No. 36837, issued by the Commission on November 6, 2025. The City states as follows: SUMMARY The City has a direct interest in understanding the impact of a rate increase, and any additional conditions thereto, on citizens of Boise who are served by Capitol Water. The City appreciates Capitol Water's continued investment in capital improvement and recognizes the importance of maintaining reliable water service. In particular, the City acknowledges Capitol CITY OF BOISE CITY'S COMMENTS - 1 Water's installation of additional pumping equipment and power generation equipment to maintain efficient well operations and assurance of adequate pressurization during outages. Having reviewed the information available in this case, the City generally supports Commission Staff s recommendations. As with the Commission Staff, the City remains concerned about the deficiencies in Capitol Water's record-keeping. The City appreciates seeking corrections when applicable rules,tariffs and regulations are not adhered to,even if unintentional, and understands that any occurrence in this case had little effect on the outcome. The City requests that these issues be addressed in any final order. RECOMMENDATIONS The City supports the approval of Commission Staff s recommendations for a rate of return of 10.08% and a rate increase of 4.4%, for the reasons stated in the Comments of Commission Staff. In addition to ordering Capitol Water to file an action plan to address its record-keeping within 90 days of the final order,the City requests that the Commission review that plan as to whether it is adequate to remedy the current deficiencies and subsequently approve the action plan. If any revisions to the action plan should occur, the Commission should retain the ability to do so. Finally, the review of rules, regulations, tariffs, etc. with Capitol Water by Commission staff will be beneficial for both Capitol Water and its customers. It may be prudent to require periodic reporting from Capitol Water of its records for the next two years (or other time frame as determined reasonable by the Commission) to ensure it is complying with its action plan and adhering to the applicable rules and regulations.
