CTC-T-25-01 SERVICES,INC.'S APPLICATION FOR A ) DETERMINATION OF WHETHER ZIPLY ) FIBER OF IDAHO, LLC AND ZIPLY FIBER ) NOTICE OF APPLICATION NORTHWEST LLC QUALIFY TO ) DISCONTINUE BASIC LOCAL EXCHANGE ) NOTICE OF UNDER IDAHO CODE § 62-612 ) INTERVENTION DEADLINE ORDER NO. 36873 On October 29, 2025, Ziply Fiber of Idaho, LLC, and Ziply Fiber Northwest LLC, both d/b/a Ziply Fiber(collectively "Ziply") filed a "Notice of Discontinuance of Service" ("Notice"). Specifically, Ziply notified the Commission of its intent to discontinue basic local exchange and message telecommunication services within certain townships near Elk City, Idaho. According to Ziply, only three customers remain within this exchange area all of whom currently receive equivalent voice and broadband service from Viasat Carrier Services, Inc. ("Viasat"). On November 28, 2025, Viasat applied for a determination of whether Ziply should be allowed to discontinue basic local exchange and message telecommunication services as described in the Notice. According to Viasat, it is not designated as an Eligible Telecommunications Carrier in significant portions of the townships in which Ziply seeks to discontinue service. The Commission now issues this Notice of Application and sets deadlines by which interested persons may intervene. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that Ziply represents that it is a telephone company that provides basic local phone and message services in Idaho, including the Elk City exchange area. YOU ARE FURTHER NOTIFIED that Ziply represents that an internal review showed only three customers still live in this exchange area, and all of them already get comparable voice and broadband service from another provider. YOU ARE FURTHER NOTIFIED that Ziply filed an affidavit of publication indicating that it had published the notice it filed with the Commission on November 26, 2025, in the Idaho County Free Press. YOU ARE FURTHER NOTIFIED that Viasat applied under Idaho Code § 62-612 for a determination of whether Ziply should be allowed to discontinue telecommunication services as described in the notice. YOU ARE FURTHER NOTIFIED that Viasat represents that it is not designated as an Eligible Telecommunications Carrier and cannot offer certain services throughout significant portions of the townships in which Ziply seeks to discontinue service. YOU ARE FURTHER NOTIFIED that the Application and supporting documentation have been filed with the Commission and are available for public inspection during regular business hours at the Commission's office. These documents are also available on the Commission's website at www.puc.idaho.gov. Click on the "TELECOM" icon, select "Open Cases," and click one of the case numbers as shown on the front of this document. YOU ARE FURTHER NOTIFIED that the Commission has jurisdiction over the Company, its filing, and the issues pertaining to this case pursuant to Title 62 of the Idaho Code NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 36873 2 and that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF INTERVENTION DEADLINE YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this matter to obtain parties' rights of participation must file a Petition to Intervene with the Commission pursuant to this Commission's Rules of Procedure 71-73,IDAPA 31.01.01.072-073. Persons who wish to intervene as a party must file a Petition to Intervene no later than 21 days after the date of service of this Order. Persons desiring to present their views without parties' rights of participation do not have to intervene and may present their comments without prior notification to the Commission or the parties. YOU ARE FURTHER NOTIFIED that the Commission Secretary shall issue a Notice of Parties after the deadline for intervention has passed. The Notice of Parties shall assign exhibit numbers to each party in this proceeding. YOU ARE FURTHER NOTIFIED that once the Notice of Parties is issued, Commission Staff will informally confer with the parties to discuss a schedule to process this case and other issues as may be raised by the parties. IT IS FURTHER ORDERED that, after the Secretary issues a Notice of Parties, Staff will informally confer with the parties to discuss the appropriate scheduling of this case. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022.
