PAC-E-25-14 POWER'S APPLICATION FOR APPROVAL ) OF THE 2026 INTER-JURISDICTIONAL ) NOTICE OF MODIFIED COST ALLOCATION PROTOCOL ) PROCEDURE ORDER NO. 36869 On August 6, 2025, Rocky Mountain Power, a division of PacifiCorp ("Company"), applied for approval of the 2026 PacifiCorp Inter-Jurisdictional Cost Allocation Protocol. The Company is proposing the 2026 Protocol to replace the 2020 PacifiCorp Inter-Jurisdictional Allocation Protocol, which was approved on April 22, 2020, extended on November 2, 2023, and expires on December 31, 2025. See Order Nos. 34640 and 35984. The Company requests that a final order issue on its Application no later than December 31, 2025. On September 9, 2025, the Commission issued a Notice of Application and Notice of Intervention Deadline,setting a deadline for interested parties to intervene. Order No. 36757. Idaho Irrigation Pumpers Association, Inc. ("IIPA") and P4 Production, L.L.C., an affiliate of Bayer Corporation("Bayer") intervened.' Order No. 36773 and 36796. During the Commission's December 9, 2025, Decision Meeting, the Commission Staff ("Staff') presented a decision memorandum, recommending that the Commission issue a Notice of Modified Procedure setting a deadline for public comments and a Staff reply deadline. The Commission now issues this Notice of Modified Procedure establishing deadlines for interested parties to comment on the Application and for the Company to reply. NOTICE OF MODIFIED PROCEDURE YOU ARE HEREBY NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter, and it will review the case through written submissions under the Commission's Rules of Modified Procedure Rules 201-204 of the Idaho Public Utilities Commission's Rules of Procedure, IDAPA 31.01.01.201-204. The Commission 1 Since then, Staff and the parties involved in the Company's pending 2026 Protocol cases in other states(excluding Washington)have met informally to work toward a single protocol acceptable to multiple states. This has resulted in the initiation of formal settlement negotiations with the Company opening on November 24, 2025.Negotiations are ongoing,with additional discussions expected in January 2026. NOTICE OF MODIFIED PROCEDURE ORDER NO. 36869 1 notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this Application may file a written comment explaining why the person supports or opposes the Application. Persons who would like a hearing must specifically request a hearing in their written comments and explain why written comments alone are insufficient. Persons interested in filing written comments must do so by April 1, 2026. Comments must be filed through the Commission's website or by e-mail unless computer access is unavailable. Click the "Case Comment Form" and complete the form using the case number as it appears on the front of this document. To file by e-mail, persons must e-mail the comments to the Commission Secretary and all parties at the e-mail addresses listed below. The Company must file any reply comments by May 1, 2026. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022. Generally, all pleadings should be filed with the Commission electronically and will be deemed timely filed when received by the Commission Secretary.See Rule 14.02. Service between parties should continue to be accomplished electronically when possible. However, voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
