MELANSON, DEPUTY ATTORNEY GENERAL DATE: DECEMBER 9, 2025 SUBJECT: IN THE MATTER OF THE INVESTIGATION INTO RED PHEASANT HOLDINGS,LLC—OWNER OF A WATER SUPPLY AND DISTRIBUTION SYSTEM; CASE NO. RED-W-24-01. On May 21, 2025, the Commission issued Order No. 36604, granting Red Pheasant Holdings, LLC ("Company") a Certificate of Public Convenience and Necessity ("CPCN"). Additionally,the Commission directed the Company to file a proposed tariff and other documents and instructed Staff to open a separate docket to evaluate whether the Company's rates are fair, just, and reasonable. On August 18, 2025, the Company submitted all but one of the required documents, including: (1) a tariff; (2) a billing statement; (3) an initial disconnection notice; (4) a final disconnection notice; (5) a notice of procedure for reconnection; and(6)a summary of rules. Staff reviewed the Company's documents, including its proposed tariff, and confirmed they conform to Order No. 36604. The Company did not submit maps defining the proposed service area. On November 3, 2025, the Company submitted the final required document, a package of county-approved plat maps that define the Company's proposed service area. (Attached hereto as Attachment 1.) Staff reviewed the package and believes the Company has satisfied its obligation under Order No. 36604. STAFF RECOMMENDATION Staff recommends the Commission approve the proposed tariff submitted by the Company on August 18, 2025, as filed, with an effective date of May 21, 2025, consistent with Order No. 36604. Staff also recommends the Commission issue a CPCN for the proposed service area. DECISION MEMORANDUM - 1 - DECEMBER 9, 2025 Further, Staff recommends opening a separate docket to initiate an evaluation of the Company's rates as contemplated by Order No. 36604. This evaluation would include sending data requests to the Company,requesting to examine Company records, and concluding with a recommendation to the Commission for further action, if any. COMMISSION DECISION Does the Commission wish to approve the documents, including the proposed tariff, submitted by the Company, as filed,with an effective date of May 21, 2025, consistent with Order No. 36604, issue a CPCN, and open a docket to evaluate whether the Company's rates are fair, just, and reasonable?
