SUBJECT: INVESTIGATION INTO RIVERVINE WATER&SEWER,LLC,OWNER OF
A SMALL WATER SUPPLY AND DISTRIBUTION SYSTEM; CASE NO.
RWS-W-25-01.
Rivervine Water& Sewer,LLC,("Company")is a private water utility located in Ada County
near Eagle, Idaho. The Company provides water to ten connections. The Company is not currently
regulated by the Idaho Public Utilities Commission ("Commission") and does not possess a
Certificate of Public Convenience and Necessity("CPCN").
At the Commission's July 8, 2025, Decision Meeting, Commission Staff ("Staff')
recommended the Commission open a docket to formally investigate whether the Company is
operating as a public utility that should be regulated by the Commission.
On August 1, 2025, the Commission issued Order No. 36701, directing Commission Staff
("Staff') to investigate the facts surrounding the regulatory status of the Company and to file a
recommendation with the Commission concerning the investigation. Staff has completed its
investigation and now makes the following recommendations to the Commission for further
proceedings.
STAFF RECOMMENDATION
Staff recommends the Commission issue a Notice of Modified Procedure establishing a
December 16, 2025, public comment deadline and a January 6, 2026, reply comment deadline.
