Idaho Power appears increasingly hostile to solar generation, and increasingly motivated by the desire to increase profit.Their profits increase by millions of dollars each consecutive quarter, whereas consumer income and buying power is functionally decreasing every quarter. Consumers are being squeezed dry financially at this time, and rate increases will harm many individuals' already strained finances. Idaho Power's hostility to residential solar generation seems apparent and unjustified given their profit margins. At a time when clean energy should be embraced, this seems like a strange move on their part. Despite their rhetoric, residential solar is engineered to reduce strain on the grid and, as I understand it, the cost of net metering is more than adequate to cover their"fair share" of maintenance costs -- especially considering the excess energy given to Idaho Power, which they then sell(again, for a profit)to residents without solar generation. Why not consider decreasing rates instead?They might make a little less profit for now, but they'll win hearts by helping people out during a difficult time. I serve as the Energy Resources Program Manager for the Shoshone- Bannock Tribes on the Fort Hall Reservation. I am submit this testimonyfor case# IPC-E- 25-16 on behalf of myself as a paying customer and based on experience from within my Tribal community, many of whom are Idaho Power customers directly impacted bythis proposed 9.7% increase, resulting in an additional$12.13 per month for the average household and $110 Million in additional annual revenue for Idaho Power. My comments today address four key areas: • Transparency and Integrity in the Regulatory Process • Disproportionate Impacts on Low-Income and Tribal Households • The Need for appropriate Consultation with Tribes • Cost-Causer Fairness: Preventing Infrastructure Costs from being shifted onto vulnerable customers Given the magnitude of this increase and recent public concerns about regulatory independence and off-record utility communication, it is essential that Idaho Power and the Commission provide clear assurances that this case was handled transparently and in accordance with Idaho Law. • What Safeguards ensured that no off-record or ex parte communications influenced the outcome of Case No. IPC-E-25-16? • How were all pre-filing and settlement related communications logged, noticed or disclosed? 12 A 9.7% increase may seem moderate on paper, but forma ny families living on fixed incomes, this creates a meaningful financial burden. As someone who provides comments in my every dayjob I have not seen this any notice or received no call for consultation in evaluating how this increase affects our members. • What analysis was conducted to determine how this rate increase affects low- income or Tribal households. • What protections or expanded assistance programs will Idaho Power implement for vulnerable customers? • Does Idaho Power track Tribal specific customer data, and if not, how can Tribal impacts be properly evaluated? • Will Idaho Power commit to appropriate consultation before filing future rate cases? • What mechanisms will the Utility Commission establish to incorporate Tribal concerns earlier in the process? • How will Idaho Power coordinate with the Tribe as we develop and implement our own Tribal Utility Code? A significant portion of Idaho Power's requested revenue increase appears tied to system upgrades and new infrastructure. However, the burden of these investments is being placed on residential customers even though large commercial users, corporations, and major generation projects are the primary drivers of grid strain. Residential and Tribal households should not be subsidizing infrastructure expansion needed for corporate growth. If major companies are creating the demand, they should pay proportionate costs through higher interconnection fees or commercial rate structures. Furthermore, the Tribes whose households are not driving grid expansion should not bear these costs, they should be exempt from such an increase. As sovereign nations, Tribes also have the ability to pursue their own generations resources, which could reduce Idaho Power's customer base. I am sure that partnerships are preferred, but fairness is essential. • What portion of this rate increase is tied to infrastructure upgrades serving large commercial or industrial users rather than residential customers? • Why are low income and Tribal households being asked to subsidize upgrades driven by corporate growth? • Will Idaho Power considered a Tribal exemption or reduced impact rate based on sovereignty and lack of contribution to grid strain? • Has Idaho Power considered higher interconnection fees for major users to reduce residential burden? • Will Idaho Power commit to exploring a cost causation model to the Tribes ensuring those driving system needs pay accordingly? I respectfully request that the Commission consider my concerns and try to work collaboratively with Tribal governments to ensure transparency, fairness, and Tribal inclusion in future proceedings. The Tribes are sovereign nations pursuing their own energy future, and we expect to be treated as meaningful stakeholders in decisions that directly affect our people and our lands. This, in myview, will balance their budget and quench their ever growing need for money. 3. Idaho power needs to reinvent itself so that residential households are not subsidizing commercial interests. a.Anything from progressive fee structures which favor commercial usage and penalize residential, to subsidizing new construction, to subsidizing highly inappropriate uses such as data centers, needs an overhaul and a shift in priority is much needed. b. Residential customers should not be subsiding commercial usage; commercial properties can pay their own way at the same rate as the rest of us. c. Residential customers should not foot the bill for new builds via higher rates; each new build should be totally responsible for the associated costs of their build including paying for the lines that feed it. d. Residential customers should not be subsidizing egregiously power hungry commercial properties such as Meta in Kuna, ID. These properties have no direct benefit to anyone except themselves, and can afford to pay their own way. 4. In general, what I am seeing with Idaho power is a power-struggle that will require heavier regulation and accountability to correct. a. Most of their policies, opinions, numbers and directions are very clearly pointed toward benefit of themselves—they seem less like a public utility and more like a corporation floating its unproven worth on the stock market. This is not right for customers on fixed incomes as well as low income and struggling families. I've put the last few years of increases for both Idaho Power and social security CoLA increases into a spreadsheet (attached) and pasted a copy into this email below. As you can see, Idaho Power has already received substantial rate increases, particularly when combined with what I understand from the news is the latest request in the last line (which is thankfully lower than what was requested in May 2025. For apples-to-apples comparison, I also listed the CoLA increases alongside, and provided the over-time impact of both. So while CoLA has risen almost 27% over the last 6 years, Idaho Power has received and requested a 45%total increase...nearly 69% more than CoLA. Idaho Power rate increases should mirror CoLA increases, or be very close. Like many, many Idahoans, Idaho Power should have to budget and operate like residential customers do, not substantially more, which only grows more pronounced overtime. If infrastructure 26 needs appear because of new construction, then those developers need to bear much of the burden causing the increased need. I am an Idaho resident and Shoshone-Bannock Tribal Member. I am aware that The Idaho Public Utilities Commission oversees investor-owned electrical utilities, which includes Idaho power. The commissioners serve the State of Idaho Citizens and utilities"By ensuring that the rates and policies established for utility services are fairjust, reasonable, and non discriminatory". I am concerned that the Commission has not upheld that responsibility in holding the utility to fair nor reasonable standards when determining their proposal. Additionally, the Open Meeting Law holds the commission responsible for transparency in their oversight responsibilities. I believe the Open Meeting Law has been adhered to and therefore, I question if the commission is not regulating utilities in the best interest of the public they serve. Another important question I have is whether the commission has heard from the majority of the public, that they will be affected by the rate change, and responded to those comments? As a Tribal Member, I am particularly interested in the Fort Hall Indian Reservation residents. Fort Hall Indian Reservation has less than 1% of the rate payers in Idaho Power's customer base. The strain on the GRID does not come from single-family households on the Reservation and they should not be expected to compensate the utilities for infrastructure strained by larger corporations. Upgrades for increase energy usage and 37 planning for potential interconnection from industrial-scale electrical loads should also not be burdened by low-income customers, in particularly the Fort Hall Indian Reservation members who are not to blame for increase in electrical usage. We can also assume Idaho Power would not be aware if Fort Hall is even planning large infrastructure projects with electrical load need, because Tribes are usually not consulted during transmission and energy planning despite critical energy infrastructure running through the Reservation. Unemployment rate exceeds national average and more than half the households on the Reservation are under the 80%AMI and qualify for low-income benefits, including LIHEAP. Reasonably, consumers who do not qualify for LIHEAP should be responsible for paying higher rates since they are a bigger strain on the GRID from interconnection of larger system sizes, resulting in the need for infrastructure upgrades. The expectation of the commissioners and utility requiring upgrades to be paid by the public equally, then the public has a right to know what infrastructure upgrades are needed and why? If large load interconnections, such are for Data Centers, and are in the queue or expecting to be placed online in the next 5 years, the commission has a moral obligation and responsibility to inform the public that all consumers will shoulder these costs for the purpose of supporting industry and large companies for the local economy. Commissioners should be aware the additional financial strain on low-income household's electrical bill from rate increases. If the rate increase is approved, and to better serve the public, commissioners should advocate with the state of Idaho for subsidizing low-income households that will be burdened by the rate increase. One suggestion is to replace the LIHEAP with state assistance, increase allocations and extend an assistance program to assist low-income households for subsidizing the rate increase they will receive on their bill. Lastly, I strongly implore the commission to uphold their mission and purpose by ensuring the public interests are respected and represented.To ensure this, I implore the commission to do the following: • Extend public comment period for 90 days and hold additional hearings for collecting more testimonies from the public in December and January. Do not commit to the Utilities proposed timeline, until the public has adequate time to comment and attend hearings between the commissioners and the utilities • Increased media attention on the commissioner's negotiations with Idaho Power to go around Open Meeting Law rule has increased negative public perception and increased distrust. Discontinue negotiations outside of the Open Meeting Law rules. • Hold one of the public comment spaces on the Fort Hall Indian Reservation. • Engage the Fort Hall Business Council formally through a consultation and prior to any decisions that affect tribal citizens and federal lands that are not governed by the state of Idaho.
