BACKGROUND
On July 1, 2025, the Wildfire Standard of Care Act ("WSCA"), Idaho Code § 61-1801 et
seq.,became effective. The WSCA requires electric corporations that are public utilities,as defined
in Idaho Code §§ 61-119 and 61-129, to file WMPs with the Idaho Public Utilities Commission.
Idaho Code § 61-1803(2)(a). Municipal and cooperative utilities may also submit WMPs for
review. Idaho Code § 61-1803(2)(b).
Once approved, a WMP defines the electric corporation's duty to its members and the
public regarding wildfire risk.Idaho Code § 61-1805. In the event of a wildfire-related lawsuit, an
electric corporation that reasonably implemented a Commission-approved WMP is presumed to
have acted without negligence regarding the cause of the fire. Idaho Code § 61-1806. Approved
WMPs must be reviewed and updated annually, and each electric corporation must submit annual
compliance reports or as otherwise directed by the Commission. Idaho Code §§ 61-1803(4), 61-
1804.
On September 30, 2025, the Commission issued Order No. 36774 adopting a filing
schedule providing that Idaho Power would file their WMP no earlier than October 1, 2025, with
updates thereto being filed annually, one year after the previously approved WMP. Id. at Exhibit
