IPC-E-25-32 COMPANY'S APPLICATION FOR ) APPROVAL OF THE COMPANY'S 2026 ) NOTICE OF APPLICATION WILDFIRE MITIGATION PLAN ) NOTICE OF INTERVENTION DEADLINE ORDER NO. 36835 On October 10,2025,Idaho Power Company("Company")applied for approval of its 2026 Wildfire Mitigation Plan ("Application"). A copy of the proposed 2026 Wildfire Mitigation Plan ("WMP") is attached to the Application as Attachment 1. The Commission now issues this Notice of Application and sets deadlines by which interested persons may intervene. BACKGROUND On July 1, 2025, the Wildfire Standard of Care Act ("WSCA"), Idaho Code § 61-1801 et seq.,became effective.The WSCA requires electric corporations that are public utilities,as defined in Idaho Code §§ 61-119 and 61-129, to file WMPs with the Idaho Public Utilities Commission. Idaho Code § 61-1803(2)(a). Municipal and cooperative utilities may also submit WMPs for review. Idaho Code § 61-1803(2)(b). Once approved, a WMP defines the electric corporation's duty to its members and the public regarding wildfire risk.Idaho Code § 61-1805. In the event of a wildfire-related lawsuit, an electric corporation that reasonably implemented a Commission-approved WMP is presumed to have acted without negligence regarding the cause of the fire. Idaho Code § 61-1806. Approved WMPs must be reviewed and updated annually, and each electric corporation must submit annual compliance reports or as otherwise directed by the Commission. Idaho Code §§ 61-1803(4), 61- 1804. On September 30, 2025, the Commission issued Order No. 36774 adopting a filing schedule providing that Idaho Power would file their WMP no earlier than October 1, 2025, with updates thereto being filed annually, one year after the previously approved WMP. Id. at Exhibit A. NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 36835 1 NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Company represents its 2026 Wildfire Mitigation Plan ("WMP") is the sixth iteration of the plan and the first submitted for approval under Idaho's Wildfire Standard of Care Act,Idaho Code § 61-1801 et seq. YOU ARE FURTHER NOTIFIED that the Company represents that the mitigation measures in the Company's 2026 WMP aim to reduce risks associated with operating its 277 substations and extensive overhead system in Idaho, which includes about 3,700 miles of transmission lines and 17,200 miles of distribution lines,representing roughly 79% and 89%of its total overhead assets, respectively. YOU ARE FURTHER NOTIFIED that the Company represents that its 2026 WMP mitigates wildfire risk by using qualitative and quantitative methods to identify areas where its equipment faces higher wildfire risk. YOU ARE FURTHER NOTIFIED that the Company represents that its 2026 WMP,which exceeds 200 pages in length,outlines standards governing line design,communication procedures, situational awareness, line operation practices, and vegetation management. YOU ARE FURTHER NOTIFIED that the Application and supporting documentation have been filed with the Commission and are available for public inspection during regular business hours at the Commission's office. These documents are also available on the Commission's website at www.puc.idaho.gov. Click on the "ELECTRIC" icon, select "Open Cases," and click one of the case numbers as shown on the front of this document. YOU ARE FURTHER NOTIFIED that the Commission has jurisdiction over the Company, its filing, and the issues pertaining to this case pursuant to Title 61 of the Idaho Code and that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF INTERVENTION DEADLINE YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this matter to obtain parties' rights of participation must file a Petition to Intervene with the Commission pursuant to this Commission's Rules of Procedure 71-73, IDAPA 31.01.01.071-073. Persons who wish to intervene as a party must file a Petition to Intervene no later than 21 days after the date of service of this Order. YOU ARE FURTHER NOTIFIED that the Commission Secretary shall issue a Notice of Parties after the deadline for intervention has passed. The Notice of Parties shall assign exhibit numbers to each party in this proceeding. YOU ARE FURTHER NOTIFIED that once the Notice of Parties is issued, Commission Staff will informally confer with the parties to discuss a schedule to process this case and other issues as may be raised by the parties. IT IS FURTHER ORDERED that, after the Secretary issues a Notice of Parties, Staff will informally confer with the parties to discuss the appropriate scheduling of this case. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022. Generally, all pleadings should be filed with the Commission electronically and will be deemed timely filed when received by the Commission Secretary.See Rule 14.02. Service between parties should continue to be accomplished electronically when possible. However, voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
