AVU-E-25-11 Complainant, ) ORDER NO. 36827 VS. ) AVISTA CORPORATION, ) Respondent. ) On July 17, 2025, Wired or Wireless, Inc. ("WOW") filed a formal complaint ("Complaint") with the Idaho Public Utilities Commission ("Commission") against Avista Corp. ("Company") (collectively, the "Parties"). On September 29, 2025, WOW filed a Motion Regarding the Procedural Schedule ("Motion"),requesting the Commission set dates for motions for summary judgment,responses to motions, replies to responses, and oral arguments. Motion at 1-2. On October 10, 2025, the Company filed a response in opposition to WOW's Motion ("Response"), arguing the Commission should deny WOW's proposed procedural schedule and resolve the matter based on the existing record, allowing the Parties to continue the proceedings in the Washington Superior Court. Response at 2. At the Commission's October 21, 2025, Decision Meeting, the Parties presented their arguments to the Commission and agreed to a schedule to allow WOW to file a responsive pleading and to meet with Commission Staff("Staff') and to discuss the issues presented in the Complaint and Answer. COMMISSION FINDINGS AND DECISION At its Decision Meeting held on October 21, 2025,the Commission heard arguments from the Parties regarding WOW's Motion and the Company's Response. The Commission determined it reasonable to grant WOW twenty-one(21)days to file a responsive pleading limited to the scope of replying to the Company's Answer. Additionally, the Commission directed Staff to convene a meeting with the Parties to discuss the issues raised in the Complaint and Answer. The Commission directed the Parties and Staff to report back to the Commission within sixty(60)days regarding any progress toward mediation and recommendations for next steps in this proceeding. We now issue this written Order in conformity with our decisions. ORDER NO. 36827 1 ORDER IT IS HEREBY ORDERED that WOW shall have twenty-one(21)days to file a responsive pleading limited to the scope of replying to the Company's Answer. IT IS FURTHER ORDERED that Staff shall convene a meeting with the Parties to discuss the issues raised in the Complaint and Answer. IT IS FURTHER ORDERED that the Parties and Staff shall report back to the Commission within sixty (60) days regarding any progress toward mediation and recommendations for next steps in this proceeding. THIS IS AN INTERLOCUTORY ORDER rather than a final and appealable Order of the Commission.While the Commission may review, stay, or clarify an interlocutory order,the period of reconsideration will not begin until the Final Order is issued.
