IPC-E-25-28 COMPANY'S PETITION TO WITHDRAW ) CERTIFICATE NO. 559,INCLUSIVE OF ) NOTICE OF PETITION THE BUILD TRANSFER AGREEMENT AND ) POWER PURCHASE AGREEMENT FOR ) NOTICE OF MODIFIED THE JACKALOPE WIND PROJECT ) PROCEDURE APPROVED BY ORDER NO. 36659 ) ORDER NO. 36805 On September 19, 2025, Idaho Power Company ("Company"), filed a petition with the Idaho Public Utilities Commission("Commission")to withdraw Certificate of Public Convenience and Necessity No. 559 and requesting that the Commission withdraw approval of the Power Purchase Agreement ("PPA") between the Company and Jackalope Wind, LLC issued in Order No. 36659. NOTICE OF PETITION YOU ARE HEREBY NOTIFIED that the Company represents that the Commission approved the Build Transfer Agreement ("BTA") and PPA for the Jackalope Project in Order No. 36659. Petition at 3. The Company states that after Commission approval, the developer faced permitting delays and uncertainty around federal land use policies, which may push the planned commercial operation date beyond 2027.Id. YOU ARE FURTHER NOTIFIED that the Company represents that it was relying on the project's 2027 commercial operation date to accommodate the Company's capacity deficits, that the Company has now entered into a Letter Agreement to terminate the BTA and PPA, and that the Company will now pursue other options to meet its capacity deficits. Id. YOU ARE FURTHER NOTIFIED that the Petition and any supporting documents are available for public inspection during regular business hours at the Commission's office. The Petition is also available on the Commission's website at www.puc.idaho.gov. NOTICE OF PETITION NOTICE OF MODIFIED PROCEDURE ORDER NO. 36805 1 YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code, and that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE HEREBY NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter, and that it will proceed under Modified Procedure pursuant to the Commission's Rules of Procedure 201-204, IDAPA 31.01.01.201-.204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this matter may file a written comment explaining why the person supports or opposes the Petition. Persons who would like a hearing must specifically request a hearing in their written comments and explain why written comments alone are insufficient. Persons interested in filing written comments must do so within 35 days from the date of this Order. Comments must be filed through the Commission's website or by e-mail unless computer access is unavailable. ORDER IT IS HEREBY ORDERED that the matter be processed by Modified Procedure. Persons interested in filing written comments must do so within 35 days from the date of this Order. The Company must file any reply comments within 49 days from the date of this Order. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022. Generally, all pleadings should be filed with the Commission electronically and will be deemed timely filed when received by the Commission Secretary.See Rule 14.02. Service between parties should continue to be accomplished electronically when possible. However, voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
