On December 27, 2024, Gem State Water Company, LLC, ("Company") filed an
application with the Idaho Public Utilities Commission ("Commission") requesting an Order
approving revisions to the Company's schedules of rates and charges for water service in the State
of Idaho, to become effective on or after February 1, 2025.
On July 31, 2025, the Commission issued Order No. 36703, approving an annual revenue
requirement of$1,137,498. The Commission directed the Company to submit conforming tariffs
in compliance with Order No. 36703 within 30 days of the order date.
On August 22, 2025, the Company filed a conforming tariff reflecting rates approved in
Order No. 36703. Staff reviewed the tariff and noted that the Company used monthly allowance
amounts in the Contract Conditions sections of Schedules No. 1 and No. 2 that differ from
Commission authorized amounts.
On September 3, 2025, the Company filed a revised tariff, which updated monthly
allowance amounts in the Contract Conditions sections of Schedules No.1 and No. 2 to match
Commission authorized amounts. Staff reviewed the Company's revised tariff and believes the
revisions improve upon the August 22, 2025, filing, and confirmed the filing complies with Order
No. 36703.
COMMISSION FINDINGS AND DECISION
The Commission has jurisdiction over the Application and the issues in this case under
Title 61 of the Idaho Code including Idaho Code §§ 61-301 through 303. The Commission is
empowered to investigate rates, charges, rules, regulations, practices, and contracts of all public
utilities and to determine whether they are just, reasonable, preferential, discriminatory, or in
violation of any provisions of law, and to fix the same by order. Idaho Code §§ 61-501 through
503.

Having reviewed the record and all submitted filings, the Commission finds that the
Company's updated tariffs submitted through a compliance filing on September 3, 2025, conform
with the provisions of Order No. 36703.
ORDER
IT IS HEREBY ORDERED that the Company's updated tariffs submitted through a
compliance filing on September 3, 2025, are approved with an effective date of August 1, 2025.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for
reconsideration within twenty-one (21) days of the service date upon this Order regarding any
matter decided in this Order. Within seven (7) days after any person has petitioned for
reconsideration, any other person may cross-petition for reconsideration. Idaho Code § 61-626.
