Tom Arkoosh and Nicholas J. Erekson of Arkoosh Law Offices, and pursuant to the Notice of Modified Procedure, Order No. 36714, entered on August 11, 2025, hereby submits the following comments of Ted Sorenson, Member of IdaHydro: 1. My name is Ted Sorenson. I have a Master of Engineering in civil engineering from the University of Idaho, Moscow, Idaho. I have been practicing civil engineering for 47 years. 2. I was registered as a professional engineer(currently entering retired status): • State of Washington#18879 • State of Idaho#3458 • State of Wyoming#3508 • State of Oregon#13890 • State of Montana#15057 • State of Colorado #45130 COMMENTS OF TED SORENSON FOR IDAHYDRO—Page 1 3. I am a principal of Sorenson Engineering ("Sorenson"), which is a member project of IdaHydro. I have designed 48 hydroelectric-related projects, all of which are still operating. There are 19 projects designed, owned, and operated by Sorenson. Sorenson owns or leases and operates an additional 11 projects. 4. My resume is attached hereto as Exhibit A. 5. I am aware of and knowledgeable about the design and costs of building,operation, and maintenance of interconnections with small hydro facilities operated under the auspices of the Public Utilities Policy Act of 1978 ("PURPA"). 6. With utilities other than Idaho Power Company("Idaho Power")to whom Sorenson sells energy from small hydro PURPA projects, Sorenson either (1) pays an annual O&M of approximately 2%2%to 3%of original construction costs, (2)pays the actual O&M as incurred, (3) paid a one-time O&M charge, or(4) operates and maintains the interconnections itself. 7. These interconnections are usual in design, commonly being a four-pole interconnection. 8. Generally, a typical four-pole interconnect costs between $140,000 and $180,000 to construct. 9. These technology of these interconnects dates back before the passage of PURPA. The interconnects are reliable, stable, and require little attention,most lasting 20-30 years or more without active work or preservation. 10. Attached hereto as Exhibit B is a spreadsheet showing, since 2014, payments to Idaho Power for operation and maintenance of interconnects for the Sorenson-operated plants that sell energy to Idaho Power. 11. Different than Schedule 72, PacifiCorp charges actual operation and maintenance costs for PURPA plants if and when charges are incurred. 12. The technology and equipment in Idaho Power and PacifiCorp interconnects are materially the same. 13. My understanding is that Idaho Power charges for operation and maintenance based upon a formula that charges PURPA projects a percentage of all the operation and maintenance of Idaho Power's transmission or distribution systems equal to the PURPA project's construction cost compared to overall system construction costs. As demonstrated above, this formula does not accurately measure or even approximate the actual cost of operation and maintenance of PURPA COMMENTS OF TED SORENSON FOR IDAHYDRO—Page 2 four-pole interconnections. This is because of the proven reliability and useful life of the four-pole interconnection compared to the expense of operating Idaho Power's overall transmission/distribution systems.The consequence is an unreasonable windfall to either the utility or its ratepayers, depending upon who retains the benefit of the overcharge. My understanding of PURPA from my years involved with these small hydro plants and their regulation requires the ratepayer to be left indifferent, neither benefited nor harmed. The current charges contravene this principle. 14. Idaho Power reports it does not record the actual costs incurred under Schedule 72. While it is surprising Idaho Power is incurring unrecorded costs, as set forth above, other utilities can and do record and bill for Schedule-72-type expenses.
