AVU-E-ll..l UTILITIES FOR AUTHORITY TO ) AVU-G-ll-01 INCREASE ITS RATES AND CHAGES ) FOR ELECTRC AND NATUAL GAS ) SERVICE IN IDAHO ) STIPULATION AN SETTLEMENT This Stipulation is entered into by and among Avist Corporation, doing business as Avista Utilities (n Avista" or "Company"), the Sta of the Idaho Public Utilities Commission ("Sta), Clearater Paper Corporation ("Clearater"), Idao Forest Group, LLC ("Idao Forest"), the Community Action Parnership Association of Idao ("CAP AI"), and the Idaho Conservation League ("Conservation League"). These entities are collectvely referred to as the "Pares," and represent all pares in the above-referenced cas that paricipated in settlement discussions. The Paries understd ths Stipulation is subject to approval by the Idaho Public Utilities Commssion ("IPUC" or the "Commission"). STIPULATION AND SETTLEMENT - A VU-E/G-II-O 1 Page 1 Exhibit NO.6 Case No. AVU-ElG-11-01 K. NOlwood, Avista Page 1 of 27 . . . I. INTODUCTION 1.The terms and conditions of this Stipulation are set for herein. The Paries agree that this Stipulation represents a fai, just and reasonable compromise of all the issues raised in the proceeding and that thi Stipulation and its acceptace by the Commission represent a reaonable resolution of the multiple issues identified in ths Stipulaton. The Paries, therefore, recommend that the Commission, in accordace with RP 274, approve the Stipulation and all of its term and conditions without material change or condition. II. BACKGROUND 2. On July 5, 20 i 1, A vista fied an Application with the Commission for authority to increase revenue from electrc and natual gas service in Idaho by 3.7% and 2.7%, respetively. If approved, the Company's revenues for electrc base retail rates would have increaed by $9.0 milion anualy; Company revenues for natual gas service would have increaed by $1.9 milion annually. The Company requested an effective date of August 5, 2011 for its proposed electrc and natual gas rate increases. By Order No. 32292, dated July 14,2011, the Commission suspended the proposed schedules of rates and charges for electrc and natural gas service for a period of thirt (30) days plus five (5) month, from August 5, 2011, until such time as the Commssion enters an Order accepting, rejecting or modifyng the Application in this matter. 3. Petitions to intervene in ths proceding were fied by Clearwater, Idaho Forest, CAPAI and the Idaho Conservation League. By varous orders, the Commssion grted these interventions. See, ¡PUC Order Nos. 32296 and 32317. 4. A settement conference was noticed and held in the Commission offces on Augut 17,2011, and was attended by signatories to ths Stipulation; fuer discussions ensued. Based upon the settlement discussions among the Paries, as a compromise of positions in ths case, and for other consideration as set fort below, the Pares agee to the following term: III. TERMS OF THE STIPULATION AND SETTLEMENT 5. Overvew of Settement and Revenue Requiement. The Paries agree that Avista should be allowed to implement revised taff schedules designed to recover $2.8 milion in additional anual electrc revenue, and $1.1 millon in additiona anua natual gas revenue, which represent a 1.1 % and 1.6% increase in electrc and natu gas anual base tarff revenues, respectively. New electric and natural gas rates would become effective October i, 20 i i. The Paries agree that this Settlement is not contingent upon any specific methodology for individua components of the revenue requirement determtion, but all Pares support the overall increase to the Company's revenue requirement, and agee tht the overal increase.represents a fai, just and reasonable compromise of the issues in ths proceeding and tht this Stipulation is in the public interest. 6. Net Impact of All Proposed Revenue Adjustments on October 1. 2011. By meas of separate fiings, several other rate adjustments are proposed to also tae effect on October 1, 20 I 1. With respect to electrc service, these proposed adjusents include the following!: a decreas of $2.2 millon in Schedule 59 for Residential Exchage benefits for residential and small far customers; a decrease of $15.5 millon in Schedule 66 Power Cost Adjustment (PCA) rates. In addition, an increae of $8.7 millon for the previously-approved adjustment for Deferred State Income taes (DSin in Schedule 99, as par of the Settlement approved in Ca No.(s) AVU-E-10-01 and AVU-G-I0-01 will take effect on October 1,201 L After tag into account the agreed-upon increase of $2.8 milion in electrc gener rate increae revenues, the net overall reduction resulti from all of the proposed aforementioned adjustments, if approved . i These proposed rate changes are included for ilustrtive puroses and are not par of this Stipulation. In addition, an increase of $0.5 millon for the.previously-approved adjustment for Deferred State Income Taxes (DSin in Schedule 199, as par of the Settement approved in Cas No.(s) A VU-E-IO-01 and A VU-G-I0-01 will tae effect on October I, 2011. After takg into account the agreed-upon increae of $1.1 millon in natal gas genera rate revenues, the net overall decreae resulting from all of the proposed aforementioned adjustments, if approved as filed, would be $0.525 millon. Attchment A sets fort these proposed October 1, 20 i 1 adjustments in more detail, and by service schedule. S These proposed rate changes ar included for ilustrtive puroses and are not par of this Stipulation.4 On August 26, 20ll, Avista wil update its pending PGA (Case No. AVU-G-Il-04) to reflect a decline in forward natu gas prices since the August i 5, 20 II PGA filing which, if approved by the Commission, would result in a 0.98% overall increase versus the previously-fied 1.53% increase. The revise-d proposed rates have been incorporated into the net proposed October 1, 2011 Revenue Change and Attchments A and C to this Stipulation. Effective Date for New Rates In This Proceeding. The Partes agree, as an integral par of the Settlement, that the effective date for new electric and natural gas rates should be October 1,2011. 8. Limitation on Effective Date of Any New Rates Established By Subsequent General Rate Filing. The Company agrees that it win not seek to make effective a change in base electrc or natual gas rates prior to April 1,2013, by meas of a gener rate filin. (Any fiing of a general rate cas, however, may be made prior to April 1,2013, but shal not request an effective date prior to April 1, 2013.) This will not prevent the Company, however, from otherse seeking to implement other rate chages affecting the rates biled to customers, including, but not limited to, adjustments under the power cost adjusent (PCA) mechasm, purchaed gas cost adjustments (pGA); DSM taff rider adjustments; etc. 9. PCA Authorized Level of Expense. The new level of power supply expense, retal load and Clearater Paper generation, and Load Change Adjustment Rate resulting from the settlement revenue requirement for puroses of the monthy PCA mechasm caculations, are detaled in Attlient B. 10. Cost of Service. As par of ths rate case, the Company prepared an analysis of using a peak credit method of classifying production costs, allocating 100% of transmission costs to demand, and allocating transmission costs to reflect any peak and off-peak seasonal cost differences on a weighted twelve month basis. The Parties have agreed to exchage information and convene a public workshop, prior to the Company's next genera rate case, with respect to STIPULATION AND SETTLEMENT -AVU-E/G-l 1-01 PageS Exhibit No.6 Case No. AVU-E/G-11-01 K. Norwood, Avista Page 5 of 27 . the method of allocation of demad and energy among the customer classes such as the possible use of a revised peak credit method for classifying production costs, as well as consideration of the use of a 12 Coincident Peak (CP) (whether "weighted" or not) versus a 7 CP or other method for allocating transmission costs. Ths workshop will also address the merits of inclining or declining block rates for service schedules 11, 21, 25 and 31. The Pares agreed, however, to spread the electric rate increase on a unform percentage basis for puroses of this Settlement. As for natual gas, the Company prepared a cost of service study and proposed tht all rate schedules be moved to unity. For settlement purpses, the Pares agreed to spread the natual gas rate increase on a unfonn percentage basis. 11. Rate Spreadte Design. (a) As indicated above, the Pares agee that the increase in base revenue would.be spread to all electrc and natul gas rate schedules on a uniform percentage basis. (b) The Parties agree that there will be an increase in the basic charges, monthy minimum charges, and demand charges in Schedules 11, 21, 25 and 146, as shown in Atthment C. (c) A uniform percentage increase will be applied to each energy rate within each electric service schedule excluding Schedule 1, residential service, where the block differential rema constat. In addition, the secnd block in Schedule 1 1 will be reduced by $0.00773 as contemplated in the Company's original filingS, and the remaning revenue requirement, after accounting for the changes in the basic charge and demand charge, wil be applied to the first energy block. . 5 See Direct Testimony of Patrick Ehrar. (d) The Paries agree that the current residential electrc basic chage of $5.00 per month will be increased to $5.25, and the residential natural gas basic charge of $4.00 per month wil be increased to $4.25. (e) Attchment C provides a sumy of the curent and revised rates and charges (as per the Settement) for electrc and natural gas service. 12. Resulting Percentage Increase by Schedule. (a) Funding for Outreach for Low-Income Conservation. The Pares agree to anual fuding of $50,000 to CAP AI for purposes of providing low-income outreach and education concerning conservation (representing an increase of $10,000 from previous fuding levels). This amount wil be fuded through the Energy Effciency Tarff Rider (Schedules 91 and 191), and wil be in addition to the $700,000 of Low-Income WeaerIzation fuding curently in place. (b) Collaboration on Low-Income Weathenzation. The Company and interested pares will meet and confer pnor to the Company's next general rate fiing in order to assess the Low Income Weathenzation and Low Income Energy Consrvation Educaton Programs and discuss appropnate levels of low-income weathenztion fuding in the futue. 14. Other Accounting Matters/Deferrals. The Parties agree to the following accountig tratment for the following items: (a) Costs Associate With Acquisition From Palouse Wind. LLC. The Company has signed a 30-year power purchase agreement with Palouse Wind, LLC, to acuie all of the power produced by a wid project that is expected to produce approximately 40 aMW. Delivenes are expected to begin in the second half of 2012. The anua cost of the Idao share of the purchased power under the contract is expected to be approximately $6.5 milion. Under terms of this Settlement, the Company shall include i 00% of the costs associated with power purchases from the wind project through the Power Cost Adjustment (PCA) until such costs, subject to prudence review, are reflected in general rates. (b) Deferred Accounting Treatment For The Varabilty In Certin Generating Plant Operation and Maintenance (O&M) Costs. In order to address the large varability in year-to-year O&M costs, beginning in 2011 the Company will be allowed to defer chages in O&M costs related to its Coyote Springs 2 (CS2) natural gas-fired generating plant located near Boardman, Oregon, and its fifteen (15) percent ownership share of the Colstrp 3 & 4 coal-fired generatig plants located in southeastern Montaa. The Company will compare actual, non-fuel, O&M expenses for the çoyote Sprigs 2 and Colstrp 3 & 4 plants with the amount of expenses authorized for recovery in base rates in the applicable deferral year, and defer the difference from that currently authorized. The deferral will occur annually, with no carng charge, with deferrd costs being amortized over a thee-year period, begining in Janua of the year following the period costs are deferred. The amount of expense to be included for recovery in futue general rate cases would be the actu O&M expense recorded in the test period, less any amount deferred durng the test period, plus the amortation of previously deferred costs. The Company would defer the operations and mainteance expenses referenced above in Account 182.3 - Other Regulatory Assets. The deferrals would be allocated to the Idaho and Washington jursdictions based on the Production I Tranmission allocation percentages in place at the tie the deferrals are made, and placed in separate Idaho and Washington sub-accounts. Account 182.3 - Other Reglatory Assets would be debited, and Account 407.4 - Regulatory Credits wil be credited as the deferrals are recorded. Amortiztion \\rill be recorded by debiting Account 407.3 - Reguatory Debits, and crediting Account 182.3 - Other Regulatory Assets. OTHER GENERA PROVISIONS 15.The Paries agree that this Stipulation represents a compromise of the positions of the Paries in this case. A.s provided in RP 272, other than any testmony filed in support of the ! approval of ths Stipuiati~n, and except to the extent necessar for a Par to explain before the Commssion its own sttements and positions with respect to the Stipulation. all statements made and positions taken in negotiations relating to this Stipulation shall be confidential and wil not be adssible in evidence in this or any other proceeding. 16. The Paries submit this Stipulation to the Commission and recommend approval in its entiety pursuant to RP 274. Paries shall support this Stipulation before the Commission, and no Par shal appeal a Commssion Order approving the Stipulation or an issue resolved by the Stipulation. If ths Stipulation is chalenged by any person not a par to the Stipulation, the Paries to ths Stipulation reserve the right to file testiony, cross-examine witnesses and put on such case as they deem appropriate to respond fully to the issues presented, including the right to raise issues that are incorporated in the settlement ters embodied in ths Stipulation. Notwthstding ths reservation of rights, the Paries to this Stipulation agree that they will continue to support the Commission's adoption of the terms of ths Stipulation. 17. If the Commission rejects any par or all of this Stipulation or imposes any additional material conditions on approval of this Stipulation, each Par reserves the right, upon wrttn notice to the Commission and the other Paries to ths proceeding, withn 14 days of the date of such action by the Commission, to withdraw from ths Stipulation. In such case, no Par shall be bound or prejudiced by the terms of this Stipulation, and each Par shall be entitled to seek reconsideration of the Commssion's order, fie testimony as it chooses, cross-examine witnesses, and do all other thngs necessa to put on such case as it deems appropriate. The Paries agree to cooperate in development of a schedule that concludes the proceeding on the earliest possible date. taing into account the needs of the Parties in paricipating in hearings and preparng testmony and briefs. 18. The Pares agee tht this Stipulation is in the public interest and that all of its terms and conditions ar fair, just and reasonable. 19. No Pary shall be bound, benefited or prejudiced by any position asserted in the negotiation of ths Stipulation, except to the extent expressly sted herein. nor shall this Stipulation be constred as a waiver of the rights of any Pary uness such rights are expressly waived herein. Exec'Ution of this Stipulation shall not be deemed to constitute an.acknowledgment by any Par of the validity or invalidity of any parcular method, theory or principle of reguation or cost recovery. No Par shall be deemed to have agreed that any method, theory or principle of reguation or cost recovery employed in arvig at ths Stipulation is appropriate for resolving any issues in any other proceeding in the future. No findings of fact or conclusions of law other th those stated herein shall be deemed to be implicit in ths Stipulation. 20. The obligations of the Pares under this Stipulation are subject to the Commssion's approval of this Stipulation in accordance with its terms and conditions and upn such approval being upheld on appeal, if any, by a cour of competent jursdiction. 21. This Stipulation may be executed in counterpar and each signed counterpar shall constitute an original document. .
