Through FirstNet services,we also provide a nationwide wireless broadband network dedicated to public safety. Between 2014 and 2023 AT&T's investments in Idaho have significantly enhanced the state's broadband infrastructure, providing improved connectivity, supporting public safety, and contributing to community development.The company's focus on expanding 5G and FirstNet capabilities ensures that Idaho residents and first responders have access to reliable and advanced communication services. Significant upgrades were made to improve reliability, speed, and overall performance. AT&T deployed 4G LTE, laying the foundation for 5G. It has introduced AT&T 5G and 5G+ in various Idaho communities, including Boise and other counties. AT&T deployed new cell sites, added wireless and wired network capacity, and added new broadband network connections in cities and areas across the state.The total investment made during this period was approximately$200 million. AT&T's total investments in its Idaho Broadband Network during the above time period exceeded the nearly$200 million spent on qualified broadband equipment for purposes of the Broadband Investment Tax Credit. AT&T invested more than $120 million in Idaho wireless networks from 2014-2016 including upgrades to reliability, coverage speed and overall performance to residents, business and first responders. For example, 189 wireless network upgrades were made in 2016, including increases in network capacity and LTE coverage. From 2017-2019, AT&T invested more than $80 million in our wireless networks in Idaho. Significant investment was made in Boise to expand coverage and improve connectivity by deploying our 5G network. From 2020-2022,AT&T invested more than $90 million in Idaho's wireless broadband network infrastructure. AT&T increased capacity in southern Idaho and expanded our network in the Treasure Valley and Lowman. We also continue to expand the Public Safety Network in Idaho by rolling out Band 14 spectrum to more than 200 sites. This is substantially greater than the minimum required, 200 Kilobits per second download speed and the 125 Kilobits per second upload speed, per statute (Idaho Code 63- 30291). Number and Percentage of Idaho Customers Served: The following figures represent AT&T service availability for Idaho residents based on population and geographic data as of August 2, 2024: 99.7%of population in Idaho covered by total network(including roaming). 74.2%of geographic area in Idaho covered by total network(including roaming). These investments are not serving non-Idaho subscribers. Equipment List: During tax years 2014- 2023, AT&T made certain investments that constitute "qualified broadband equipment" within the meaning of Section 63-30291(3)(b), Idaho Code. Exhibit A, attached, describes AT&T's qualified broadband equipment investments and contains the information required by this Commission's Order No. 35297 (Public Utilities Commission Case No.GNR-T- 21-10) Statement Certifying Qualification of Eligible Broadband Equipment: I hereby certify that I have read the applicable statutes for the broadband investment income tax credit and believe that the equipment listed herein qualifies for the tax credit under Idaho Code §63-30291. GNR-T-24-06 LLC'S APPLICATION FOR THE 2014 ) THROUGH 2O24 BROADBAND EQUIPMENT ) ORDER NO. 36532 TAX CREDIT ) On November 14,2024,AT&T Mobility II LLC.1 ("Company")applied to the Idaho Public Utilities Commission ("Commission") seeking an order approving equipment, installed and put into operation during the calendar years 2014-2023, as eligible for the broadband tax credit. The Company stated that it offers mobile broadband technologies over its wireless broadband network,including but not limited to voice and data services,messaging,location-based services, over-the-air downloadable applications, video on demand, and push-to-talk. The Company also provides a nationwide wireless broadband network dedicated to public safety through FirstNet services. For its network description, the Company stated that it has implemented the Distributed Radio Access Network architecture at its cell tower locations throughout Idaho. The Company represented that the components installed at its cell tower locations included tower or other supporting structure; antennas; coaxial cables; remote radio heads; remote radio units; fiber optic cables and power cables; shelter containing power supply components, baseband units, and smart integrated access devices. The Company confirmed that it offers broadband services to its customers at transmission rates between 14 Megabits per second and 38 Megabits per second for download speeds and between 1 Megabit per second and 3 Megabits per second for upload speeds. The Company represented that its speeds are greater than the minimum required by the Idaho Code § 63- 3029I(3)(b). The Company stated that, when including roaming, as of August 2, 2024, 99.7% of the population in Idaho and 74.2% of the geographic area in Idaho is covered by its total network. 1 The Company is a subsidiary of AT&T Inc. and is registered with the Idaho Secretary of State as a foreign liability company. ORDER NO. 36532 1 The Company certified that during calendar years 2014 through 2023, it made substantial investments in Idaho that constitute "qualified broadband equipment" and is "necessary to the provision of broadband services and an integral part of a broadband network." The Company represented that its investments have totaled $208,296,295 during this period. THE BROADBAND EQUIPMENT TAX CREDIT In 2001,the Idaho Legislature enacted House Bill 377 authorizing an income tax credit for the installation of qualifying broadband infrastructure in Idaho. Idaho Code § 63-3029B. Section 63-3029I allows a taxpayer to receive an income tax credit for eligible broadband equipment installed during a calendar year. Qualified broadband equipment is defined as those network facilities "capable of transmitting signals at a rate of at least two hundred thousand(200,000) bits per second(bps)to a subscriber and at least one hundred twenty-five thousand(125,000)bps from a subscriber."Idaho Code § 63-3029I(3)(b). If the equipment is installed by a telecommunications carrier, it must also be "necessary to the provision of broadband services and an integral part of a broadband network."Idaho Code § 63-3029I(3)(b)(i). To be eligible for the income tax credit, the taxpayer must obtain an order from the Commission confirming that the installed equipment meets the statutory definition of qualified broadband equipment. Commission Order No. 35297; Idaho Code § 63-3029I(4). Once the Commission has determined the installed equipment is eligible for the income tax credit, the Commission will issue an order granting the application, and the Commission will forward the order and application to the Idaho Tax Commission. STAFF REVIEW Commission Staff ("Staff') reviewed the Application and audited the list of broadband equipment submitted by the Company. During its review, Staff was not able to verify that all of the broadband equipment listed in the Application fully complied with the requirements of Commission Order No. 35297, which requires such information as the brand, manufacturer, and model number of the listed broadband equipment. Staff requested the missing information through production requests, and in its response to Staff Production Request #3, the Company separated the list of broadband equipment into two segments,"Attachment A"and"Attachment B".Attachment A lists the broadband equipment with all of the information Staff believed was required to comply with Commission Order No. 35297; however,Attachment B lists broadband equipment that does not have all the required information. ORDER NO. 36532 2 Staff represented that on March 13,2025, Staff and representatives for the Company agreed that the best path forward was to limit the Application for approval to the equipment listed in Attachment A, and for the Company to submit a new application for the equipment listed in Attachment B when the Company was able to provide the required information. Based on its review, Staff believed the equipment identified in Attachment A qualifies for the investment tax credit pursuant to Commission Order No. 35297 and Idaho Code § 63- 3029I(3)(b). Staff recommended the Commission: (1) issue an order confirming that the Company's equipment listed in Attachment A is qualified broadband equipment, and (2) forward copies of the Application with Attachments and the order to the Idaho State Tax Commission. COMMISSION FINDINGS Having reviewed the Company's Application and Staff s recommendation, the Commission finds that the Company's equipment identified in Attachment A, in Case No. GNR- T-24-06, is qualified broadband equipment eligible for the income tax credit under Idaho Code § 63-3029I. The Commission makes no findings regarding the costs of the installed broadband equipment or other expenses. The Company may file a new application at a later date for the Commission to consider the equipment listed in Attachment B. ORDER IT IS HEREBY ORDERED that the Company's Application is granted with respect to the equipment listed in Attachment A. Page 2 News Release AT&T Invests More Than $120 Million Over 3-Year Period to Enhance Local Networks in Idaho BOISE, Idaho, May 18, 2017 — At 1T&T1, we've invested more than $120 million in our Idaho wireless networks during 2014-2016. These investments drive a wide range of upgrades to reliability, coverage, speed and overall performance for residents and businesses. They also improve critical services that support public safety and first responders. In 2016, AT&T made 189 wireless network upgrades in Idaho. We added network capacity, LTE coverage and launched High Definition Voice. "We're investing to provide fast, reliable, highly secure connectivity. We want customers to have internet access at any moment, from almost any device—anywhere," said Tara Thue, director of external affairs, AT&T-Idaho. "These continued investments bring Idaho residents and businesses a host of new opportunities." The AT&T LTE network covers nearly 400 million people in North America. Notable Idaho network enhancements in 2016 included: • Added network capacity in Boise, Idaho Falls, Pocatello, Twin Falls, Soda Springs, Meridian, Nampa, Mountain Home, Roberts, Ashton, Idaho City, New Plymouth, Rexburg and Wilder; • Added LTE to cell sites in Carey, Murphy, Pingree, Atomic City and Eden; • Launched HD Voice allowing crystal clear LTE calls in Boise, Mountain Home, McCall, Pocatello, Twin Falls and Idaho Falls. The First Responder Network Authority (FirstNet) recently chose AT&T to build a nationwide public safety broadband network. The network will be dedicated to America's police, firefighters and EMS personnel. Should Idaho opt-in to the FirstNet network, we will build upon our current and planned investments with a dedicated focus on the state's first responders. And we would expect to make a significant investment to upgrade and maintain Idaho's FirstNet network over the next 25 years, bringing your first responders the coverage, value and experience they expect.
