HomeMy WebLinkAbout20061127min.docIDAHO PUBLIC UTILITIES COMMISSION MINUTES OF DECISION MEETING November 27, 2006 – 1:30 P.M. In attendance were Commissioners Paul Kjellander, Marsha Smith and Dennis Hansen. Commissioner Kjellander called the meeting to order. The first order of business was approval of MINUTES FROM PREVIOUS MEETING on November 20, 2006. Commissioner Kjellander moved for approval of the minutes. A vote was taken on the motion and it carried unanimously. The second order of business was approval of the CONSENT AGENDA, items 2 - 5. Regarding item 5, Commissioner Smith asked about the use of modified procedure in light of the comments the Commission has received from customers requesting a public hearing. Terri Carlock responded that staff plans on having a public hearing if necessary but recommends using modified procedure for the technical aspects of the case. Commissioner Smith cautioned that customers should not get the impression there won’t be a hearing. There was no further discussion and Commissioner Kjellander moved for approval of Consent Agenda items 2 – 5. A vote was taken on the motion and it carried unanimously. The next order of business was MATTERS IN PROGRESS: Cecelia Gassner’s November 17, 2006 Decision Memorandum re: AT&T Communications of the Mountain States, Inc.’s Complaint Against Qwest Corporation, Case No. QWE-T-06-17. Ms. Gassner reviewed her Decision Memo. She stated that the decision before the Commission is whether or not to establish an oral argument schedule in this matter and if so, should additional issues be addressed including the meaning and effect of the governing law provision in the agreement, the meaning and effect of the dispute resolution provision in the agreement, and the effect, if any, of Idaho Code, Section 61-642 in the dispute. Commissioner Hansen moved that the Commission establish a schedule to hear oral argument in this matter including the three additional issues outlined by Ms. Gassner. A vote was taken on the motion and it carried unanimously. The only other items on the agenda were under the category of FULLY SUBMITTED MATTERS and Commissioner Kjellander stated they would be deliberated privately. He then adjourned the meeting.
