AGAINST VEOLIA WATER IDAHO, INC. ) ORDER NO. 36705
On June 13, 2025, Homecraft Homes, LLC ("Homecraft") filed a formal complaint
("Complaint") with the Idaho Public Utilities Commission("Commission") against Veolia Water
Idaho, Inc. ("Company") concerning the number of meters required under the Company's tariffs
to service accessory dwelling units ("ADUs") attached to main homes by an unenclosed roof.
DISCUSSION AND FINDINGS
Commission Rule of Procedure 43 provides that in a quasi-judicial proceeding before the
Commission, such as a formal complaint, "[a] partnership or corporation shall be represented by a
licensed attorney."Homecraft is a limited liability company and is therefore required to have legal
representation to maintain its Complaint. Homecraft's Complaint does not indicate that it is
currently represented by a licensed attorney in this matter.
Accordingly, we find it reasonable to provide Homecraft with fourteen (14) days from the
service date of this Order to retain counsel and file a Notice of Representation indicating whether
Homecraft wishes to file an amended Complaint with the assistance of counsel.
If Homecraft does not file a Notice of Representation in the time allotted, we may enter a
final order dismissing Homecraft's Complaint.
ORDER
IT IS HEREBY ORDERED that Homecraft's Complaint is conditionally dismissed.
IT IS FURTHER ORDERED that Homecraft has fourteen (14) days from the service of
this Order to retain counsel and file a Notice of Representation.
THIS IS AN INTERLOCUTORY ORDER, not a final and appealable order of the
Commission. The period to seek reconsideration will not begin until a final order issues.
