HomeMy WebLinkAbout20250423Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER LODGE COMMISSIONER HAMMOND COMMISSIONER HARDIE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: CHRIS BURDIN DEPUTY ATTORNEY GENERAL DATE: APRIL 23, 2025 SUBJECT: IN THE MATTER OF IDAHO POWER COMPANY'S APPLICATION FOR APPROVAL OF SPECIAL CONTRACT AND TARIFF SCHEDULE 28 TO PROVIDE ELECTRIC SERVICE TO MICRON IDAHO SEMICONDUCTOR MANUFACTURING (TRITON) LLC.; CASE NO. IPC-E-24-44. On December 6, 2024, Idaho Power Company ("Company") filed an application ("Application") with the Idaho Public Utilities Commission ("Commission") requesting an order approving the Special Contract for electric service between the Company and Micron Idaho Semiconductor Manufacturing (Triton) LLC ("Micron"), for Micron's new memory manufacturing fabrication complex ("Micron FAB"), and approving the rates proposed in tariff Schedule 28. On January 27, 2025, the Commission issued a Notice of Application and Notice of Modified Procedure establishing a March 12, 2025, initial comment deadline, and a March 26, 2025,reply comment deadline. Order No. 36446. The Commission granted intervention to Micron Technology, Inc. ("Micron"), the Idaho Irrigation Pumpers Association, Inc. ("IIPA"), and the Industrial Customers of Idaho Power("ICIP"). Order Nos. 36460, 36479, 36483. On February 20, 2025, IIPA filed an Objection to Modified Procedure, Demand for Hearing, and Motion to Consolidate for Hearing with Interrelated Cases ("Motion"). IIPA requested oral argument on the Motion. During the Commission's March 4, 2025, decision meeting, Commission Staff("Staff') recommended that the Commission establish a schedule for oral argument, or any other procedure deemed necessary by the Commission. Staff also recommended that the Commission vacate the DECISION MEMORANDUM I comment deadlines set in Order No. 36446 and set a new procedural schedule upon resolution of the Motion. On March 14, 2025, the Commission issued Order No. 36512 vacating the comment deadlines and setting a date for oral argument. After hearing oral argument, on April 15, 2025, the Commission issued Order No. 36547 granting in part and denying in part IIPA's Motion. The Commission directed Staff to consult with all parties on a proposed procedural schedule. Order No. 36547 at 4. STAFF RECOMMENDATION Staff recommends that the Commission issue a Scheduling Order establishing the following procedural schedule: • April 30, 2025: Company Direct Testimony • June 30, 2025: Staff and Intervenor Response Testimony • July 30, 2025: All Party Rebuttal Testimony Additionally, Staff recommends the Commission set a subsequent Technical Hearing in late August to early September, at a time and date determined by the Commission.
