CASE NO. GNR- T -97- ORDER NO. 30320 On May 14, 2007, Western CLEC Corp. filed a request to surrender and terminate Certificate of Public Convenience and Necessity No. 346 and cancel its tariff in Idaho. The Company stated it has no customers in Idaho. In its Decision Meeting on May 21 , 2007, the Commission determined to approve Western s request for cancellation of Certificate No. 346. COMMISSION FINDINGS In December 1997, Eclipse Communications Corporation filed an Application with the Commission requesting authority to provide telecommunications services within the State ofIdaho. In May 1998, the Commission granted Eclipse s Application for a CPCN to provide telecommunications services within Idaho. Order No. 27536. In March 2003 , Western Wireless Corporation filed a request for a name change from Eclipse Communications to Western CLEC Corp. The Commission granted Western s request for a name change and a CPCN was issued to Western CLEC Corp. Order No. 29211. On May 14, 2007, Western requested cancellation of its Certificate and stated that it does not provide local exchange services to any customers within Idaho; therefore, no customers will be affected by this cancellation. Staff recommended the Commission cancel Certificate No. 346 and remove the Company s tariff on file. ORDER IT IS HEREBY ORDERED that Western CLEC Corp.s request for cancellation of Certificate of Public Convenience and Necessity No. 346 is granted. Certificate No. 346 is no longer in effect, and Western is no longer authorized to provide services in the State of Idaho. THIS IS A FINAL ORDER. Any person interested in this Order or in interlocutory Orders previously issued in this case may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this case. Within seven (7) days after any person has petitioned for ORDER NO. 30320 reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ ~ 61-619 and 61-626.
