MNL-T-24-01. BACKGROUND On December 17, 2024, Millennium Networks, LLC ("Company") submitted a Petition to the Idaho Public Utilities Commission (the "Commission") to demonstrate that it still meets the requirements necessary to hold its Certificate of Public Convenience and Necessity ("CPCN"); No. 494, as the same; Petition at 1. The Company submitted this Petition pursuant to Commission Order No.36077 of Case No. MNL-T-23-01/CTL-T-23-03, Notice of the Acquisition of Certain Assets of CTC by Millenium Networks, LLC. The Company was ordered to file this Petition, with supporting materials, to demonstrate that it still satisfies the requirements for a CPCN certificate after purchasing all the assets of CTC Telecom, Inc. in Ada County, Idaho. Order No.36077 at 6. THE PETITION On December 17, 2024, pursuant to Commission Order No.36077 of Case No. MNL-T- 23-01, the Company submitted this Petition to demonstrate satisfaction of the criteria for keeping the CPCN certificate No. 494. This certificate grants the Company the authority to provide local exchange telecommunications services in Idaho pursuant to IDAPA 31.01.01.114 and Commission Order No. 26665. DECISION MEMORANDUM - 1 - FEBRUARY 4, 2025 The Company stated that it is a facilities-based telecommunications company, and it currently provides voice and broadband services to over 4,000 customers (both residential and commercial) across the State of Idaho, including Ada, Bonneville, and Madison Counties. These services are provided primarily over fiber optic facilities. Petition at 2. The Company confirmed that it is a Wyoming limited liability company, registered with the Wyoming Secretary of State since January 29,2004(Exhibit A of Petition). It is also registered with the Idaho Secretary of State as a foreign limited liability company(Exhibit B of Petition),and its physical corporate address is 1670 North Highway 33 Driggs, ID 83422. Id at 2. The Company provided its service territory information, the names and addresses of its officers and owners, and the relevant corporate financial information and all other relevant information in compliance with IDAPA 31.01.01.114. Id 2—5. STAFF ANALYSIS Staff reviewed the Company's Petition and the supporting materials. Staff believes the Company understands the Commission's rules and requirements for providing telecommunication services in Idaho. Staff confirmed that the Company has demonstrated that it still possesses the requisite financial,managerial,and technical qualifications necessary to continue to hold its CPCN certificate No. 494 and operate as a provider of competitive local exchange telecommunications services in Idaho. The Commission has jurisdiction over the issuance of CPCN certificates in Idaho,pursuant to IDAPA 31.01.01.114 and Commission Order No. 26665. The Company was granted the CPCN certificate No. 494 on March 17, 2010,by Commission Order No. 31027 of Case No. MNL-T-09- 01, to provide competitive local exchange telecommunications services within Idaho. The CPCN certificate was subsequently issued on May 21, 2010. The Company has continuously operated under CPCN No. 494, including the present date. DECISION MEMORANDUM - 2 - FEBRUARY 4, 2025 STAFF RECOMMENDATION Staff recommends that the Commission approve the Company's Petition and enter a confirmatory Order in this matter.
