HomeMy WebLinkAbout20241126Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: DAYN HARDIE DEPUTY ATTORNEY GENERAL DATE: NOVEMBER 26, 2024 SUBJECT: IN THE MATTER OF THE PETITION TO CANCEL CPCN NO. 317 FOR ISLAND PARK WATER COMPANY; CASE NO. ISL-W-24-01. On October 15,2024,the Commission received a petition from Rigby,Andrus&Rigby Law ("Rigby Law") informing the Commission that Island Park Water Company, Inc. ("Island Park") had been judicially dissolved under the direction of the Receiver, Big Springs Water Company, LLC. To wind up outstanding matters related to Island Park, Rigby Law requested the Commission cancel Certificate of Public Convenience and Necessity No. 317, which belonged to Island Park("Petition"). Rigby Law noted that Island Park's assets had been transferred to Caldera Water Company, Inc. ("Caldera"), an Idaho Non-profit corporation, which is not subject to this Commission's regulation. Caldera will operate and maintain the seven water systems formerly owned and operated by Island Park. STAFF RECOMMENDATION Staff recommends the Commission issue a Notice of Petition and Notice of Modified Procedure establishing a December 17, 2024,public comment deadline and a December 24, 2024, reply deadline.
