SWI-W-24-01 INC.'S APPLICATION FOR A ) CERTIFICATE OF PUBLIC CONVENIENCE ) ORDER NO. 36394 AND NECESSITY ) On March 28, 2024, Syringa Water Company Inc. ("Company") applied for a Certificate of Public Convenience and Necessity ("CPCN"), to provide water service near Coeur d'Alene, Idaho. On June 6, 2024, the Commission issued a Notice of Application and established public comment and Company reply deadlines. Order No. 36212. Staff submitted comments and three members of the public filed comments. The Company did not reply. On August 14, 2024, the Commission issued Order No. 36290, granting the Company a CPCN to operate as a water utility within the State of Idaho and further ordered the Company to (1)file updated and complete information about its water rights; (2)provide a full legal description of all parcels connected to the Company's water system; and (3) submit a Tariff, a billing statement, an initial disconnection notice, a final disconnection notice, a notice of procedure for reconnection, and a summary of rules. On August 26,2024,the Company submitted the legal description for the parcels connected to the Company's water system that were omitted from the Application. On August 27, 2024, the Company submitted its updated and complete water rights information. On September 25, 2024, the Company filed the remaining documents required by Order No. 36290, including: (1) a Tariff; (2) a billing statement; (3) an initial disconnection notice; (4) a final disconnection notice; (5) a notice of procedure for reconnection; and(6) a summary of rules. The Commission Staff ("Staff') reviewed the document and other information the Company submitted, including its Tariff, and confirmed they conform to Order No. 36290. During the Commission's October 8, 2024, decision meeting, Staff presented a Decision Memorandum recommending that the Commission approve the Tariff the Company submitted, effective August 14, 2024. Additionally, Staff s Decision Memorandum recommended that the Company's CPCN reflect the service territory set forth in Attachment 1 to Staffs October 8, 2024, Decision Memorandum. ORDER NO. 36394 1 COMMISSION FINDINGS AND DECISION Having reviewed the record and the Company's submissions and Staff s recommendation, the Commission finds that the Company has submitted the documents and other information required by Order No. 36290. We hereby approve the Company's Tariff as filed, effective as of August 14, 2024. Additionally, the Company's service territory, as reflected in its CPCN, shall be consistent with that contained in Attachment 1 to Staff s October 8,2024,Decision Memorandum. ORDER IT IS HEREBY ORDERED that the legal description, the water right, other documents, and Tariff the Company submitted to comply with Order No.36290,are approved with an effective date of August 14, 2024. IT IS FURTHER ORDERED that the legal description of the Company's service territory contained in its CPCN shall be that listed in Attachment 1 to Staffs October 8, 2024, Decision Memorandum. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date upon this Order regarding any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. Idaho Code § 61-626.
