HomeMy WebLinkAbout20241119Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: ADAM TRIPLETT DEPUTY ATTORNEY GENERAL DATE: NOVEMBER 19, 2024 SUBJECT: IN THE MATTER OF PRIEST LAKE WATER, LLC'S APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY; CASE NO. PLW-W-24-01. On October 8, 2024, Priest Lake Water, LLC ("Company") applied for a Certificate of Public Convenience and Necessity ("CPCN") to provide water service to a 113-lot subdivision near Priest Lake in Bonner County, Idaho. The Company also requested Commission approval to increase its service rates from a single flat monthly rate of$37.00 to a flat monthly rate of$98.00 for residential customers and$100.00 for commercial customers. STAFF RECOMMENDATION Staff believes the Commission should address the Company's requests for a CPCN in the present case and for authorization to increase rates in a separate case. Accordingly, Staff recommends that the Commission issue a Notice of Application and Notice of Modified Procedure, establishing a December 13, 2024, deadline for public comments on the Company's Application for a CPCN, and a December 20, 2024, Company reply deadline. Staff further recommends that the Commission open a new docket and transfer the Company's request to increase rates to that docket, where it will be processed following issuance of a final order in this case.
