Certificate of Public Convenience and Necessity Number 239
COMES NOW Capitol Water Corporation ("Company"), holder of Certificate of Public
Convenience and Necessity ("CPCN")No. 239,to request an investigation into Flying H Trailor
Ranch. Flying H Trailor Ranch ("Flying H") is a public utility operating within our franchise
area and owns a water system that serves a mobile home trailer park. Flying H has been
providing water to their tenants from 2 of their own wells. The Company provides water to 22
units of the trailer park, the office area, and one other building. Please see attached file with
addresses and monthly charges.

Pursuant to Idaho Code §§ 61-104, 125, 129, 526 through 528, Flying H may be
operating as a water corporation, a public utility, and does not have a CPCN, or approval,to
serve its customers.
This has caused harm to the company, as it is lost income, due to not providing water
service to customers of Flying H. We have a very limited growth area, and we need to be able to
add these users to our service base. The customers could not be getting the service and benefits
that they deserve by over-paying for water services. The Company stands ready to begin serving
the customers upon a Final Order.
The Company requests the Commission to open an investigation into Flying H and find it
a public utility and operating illegally within our certificated area. The Company requests that
the Commission process this Application under its rules of modified procedure.
