MINUTES OF DECISION MEETING
SUBJECT TO APPROVAL
October 15, 2024—1:30 p.m.
In attendance was Commissioner Eric Anderson, Commissioner John R. Hammond, Jr. Commissioner
Lodge participated via phone. Commissioner Anderson called the meeting to order.
The first order of business was the APPROVAL OF MINUTES FROM THE PREVIOUS MEETING
on October 8th, 2024. The Commission voted unanimously to approve the minutes as written.
The next order of business was CONSENT AGENDA:
2. Action Item: Michael Duval's October 15,2024,Decision Memorandum re: In the Matter of the
Application of Idaho Power Company's Compliance with Order No. 36402 for Authority to Track
Annual Wheeling Revenues in the Power Cost Adjustment; Case No.IPC-E-24-38.
3. Action Item: Chris Burdin's October 15, 2024,Decision Memorandum re: In the Matter of the
Application of Idaho Power Company for Authority to Fund Its Continued Participation in the
Northwest Energy Efficiency Alliance in 2025-2029 through the Energy Efficiency Rider; Case No.
IPC-E-24-35.
4. Action Item: Michael Eldred's October 15, 2024, Decision Memorandum re: In the Matter of
Idaho Power Company's Application for Approval of a Clean Energy Your Way Construction
Agreement with the City of Boise and the First Amendment Thereto; Case No.IPC-E-24-18.
Commissioner Anderson made a motion to approve Staff's recommendations for Items 2 through 4 under
the Consent Agenda. A vote was taken on the motion,and it carried unanimously.
The next order of business was MATTERS IN PROGRESS:
5. Action Item: Michael Duval's October 15, 2024, Decision Memorandum re: In the Matter of
Michael Ayers' Formal Complaint Against Ziply Fiber of Idaho,LLC Case No. CTC-T-24-01.
Michael Duval presented the decision memorandum regarding Mr. Ayers formal complaint against Ziply
Fiber of Idaho,LLC. Mr. Duval informed the commission that Staff suggested a hearing might be
necessary as Ayers plans to call witnesses. Additionally, staff highlighted several customers echoing
concerns about the issue.
Commissioner Hammond felt it premature to organize a public or technical hearing without first obtaining
Ziply Fiber's written response. Commissioner Hammond stressed the importance of building a more
developed record and it was deemed crucial before deciding on further actions, including the necessity of
a public or technical hearing.The potential for hearings or other procedural steps will be reconsidered
after the company's response.
Commissioner Anderson made a motion to first issue a summons to Ziply Fiber for a formal response within
21 days before proceeding further.A vote was taken, and the motion passed unanimously.
Commissioner Anderson stated there was no further business before the Commission and the meeting was
adjourned.
