HomeMy WebLinkAbout20241029Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: MICHAEL DUVAL DEPUTY ATTORNEY GENERAL DATE: OCTOBER 29, 2024 SUBJECT: IN THE MATTER OF ROCKY MOUNTAIN UTILITY COMPANY, INC.'S APPLICATION TO AMEND ITS CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY; CASE NO. ROC-W-24-01. On August 23, 2024, Rocky Mountain Utility Co., LLC d.b.a. Rocky Mountain Utilities Co., Inc.' ("Company") applied to the Idaho Public Utilities Commission ("Commission") for approval to amend its Certificate of Public Convenience and Necessity ("CPCN") to allow the Company to expand its service territory to include a newly created subdivision; the Company also noted that it had built new wells and related infrastructure ("Application"). The Company has submitted supplemental filings relevant to its request. The Company requested that its Application be processed by Modified Procedure. On October 10,2024,the Commission issued a Notice of Application and set deadlines for public comments and the Company's reply. Order No. 36346. STAFF RECOMMENDATION Commission Staff ("Staff') believes that, apart from the area covering the subdivision requested above, the Company is currently serving an area not covered by its CPCN. Staff has repeatedly asked the Company to submit an amended application that also accounts for this service territory in the requested relief. However, the Company has failed to submit such a filing. Staff recommends that the Commission: ' The Idaho Secretary of State's website lists the Company's official name as "Rocky Mountain Utility Company, Inc."The Company's Application states that this is the name which it is doing business under. DECISION MEMORANDUM 1 1) Order the Company to submit an amended application within 30 days of the Commission's order that accurately describes all of the service territory that the Company currently serves and plans to serve. 2) Order that this case be suspended with a new procedural schedule to be determined once the Company has complied with the proposed order discussed above.
