Audit consisted of Idaho PUC inspectors Perkins and Galli reviewing DPCs Drug and Alcohol Program for
compliance with Part 40 and Part 199 with Andrea Shacklett(Director of Regulatory Compliance).

Prepared for Drug and Alcohol program audit.
September 13, 2022: (2.0 Standard)
Audit included review of DPC 2022 Drug and Alcohol Program and appendances, drug and alcohol records and
PHMSA IA question set. Three concerns were found that need to be corrected.
Question 9: Return-to-Duty Alcohol Testing-Add referral
(a) As an employee, when you have violated DOT drug and alcohol regulations, you cannot again perform any
DOT safety-sensitive duties for any employer until and unless you complete the SAP evaluation, referral, and
education/treatment process set forth in this subpart and in applicable DOT agency regulations. The first step in
this process is a SAP evaluation.
Question 10: Follow-Up Alcohol Testing-Add alcohol
Need to add alcohol to the follow-up testing as required by 199.225D, operators D&A manual pg 18 section F
only states drugs.
Question 13: Prohibited from performing covered tasks-Cite code 199.225(e)
Change to cite code: e), "Each employer shall retest a covered employee to ensure compliance with the
provisions of 199.237, if an employer chooses to permit the employee to perform a covered function within 8
hours following the administration of an alcohol test indicating an alcohol concentration of 0.02 or greater but
