ASP-W-24-02 COMMENTS OF THE COMMISSION STAFF COMMISSION STAFF (“STAFF”) OF the Idaho Public Utilities Commission, by and through its Attorney of record, Dayn Hardie, Deputy Attorney General, submits the following comments. BACKGROUND On August 20, 2024, Aspen Creek Water Co., Inc. (“Company”) applied to amend its Certificate of Public Convenience and Necessity No. 403 (“CPCN”). The Company requests to enlarge its existing CPCN to incorporate property that is contiguous to its existing system and certificated area where it intends to serve a new customer who has requested service from the Company. The Company proposes to serve the customer though infrastructure that would be paid for by the Company or in agreement with the customer. RECEIVED Wednesday, October 9, 2024 12:50:34 PM IDAHO PUBLIC UTILITIES COMMISSION STAFF COMMENTS 2 OCTOBER 9, 2024 The Company provided proof of authorization it received from the Idaho Department of Environmental Quality (“IDEQ”) which allows it to upgrade and expand its system to meet additional demand, including the customer requesting service. STAFF ANALYSIS Staff reviewed the Company’s Application, exhibits, and supplemental information provided. Staff based its analysis on Idaho Code § 61-526 and focused on the following items specifically: (1) if the proposed area accurately describes the area that the Company would like to provide service, (2) if the proposed area encroaches upon or interferes with other public utilities, and (3) if the proposed area is within the limits of the Company’s water rights. Staff confirmed the proposed amendment to the Company’s service area complies with the scope of its statutory review in that it: (1) accurately describes the area the Company would like to provide service, (2) does not encroach upon or interfere with other public utilities, and (3) is within the limits of the Company’s water rights. Based on its review, Staff recommends the Commission approve the amendment to CPCN No. 403 to include: (1) the legal descriptions provided in Attachment A, and (2) the map of the service area provided as Attachment B. Attachment A includes a list of the individual legal descriptions within the Company’s proposed service area, which are based on the Company’s legal descriptions provided in the Application. Attachment B includes a map of the proposed service area and provides an illustrated view of the boundaries for the proposed amendment to the service territory. The list of legal descriptions serves as an index for the detailed maps and property descriptions, which Staff included as separate exhibits within Attachment A. These property descriptions and the plat map are from the Application and Staff believes they accurately describe the area that the Company is proposing to serve. Staff reviewed IDEQ information, Idaho Department of Water Resources (“IDWR”) information, and Commission information to determine if the amendment to the service area encroaches upon or interferes with other public utilities and is within the limits of the Company’s water rights. Based on the IDEQ information provided in the Company’s Application, IDEQ well information, and Commission information on public utilities in the area, Staff believes the amendment to the service area does not encroach upon or interfere with other public utilities.
