Below you will find our responses:
• Response 1: We apologize for the discrepancy. This should be filed under CPCN 481.
CPCN 296 is not associated with Rocky Mountain Utility Co., Inc
• Response 2: The requested expansion area includes all of Division No. 3
• Response 3 The entire Pepperwood Crossing Subdivision was platted in three plats or
divisions. The approved and recorded plats are attached as well as the phasing of
construction. Construction of the three plats was completed in 3 phases that do not
correspond to the plat divisions. Phase 1 of construction included both Division 1 and
Division 2 plats, and construction was started in late 2006 and completed in 2007. Phase
2 of construction included the southern and eastern portions of the Division 3 plat with
construction starting in the Spring of 2021 and completed in 2022. Phase 3 of
construction consists of the northern and western portion of the Division 3 plat and
construction was started in 2023 and completed in 2024. See attachment, 'Response 3'.
• Response 4: The water system for Pepperwood Crossing had adequate capacity to
provide water for the entire subdivision except for the firm pumping capacity rule
required by Idaho DEQ. The firm pumping capacity rule requires delivery of sufficient
water during the Peak Hourly Demand (PHD) and the Maximum Daily Demand (MDD)
with the largest pump/well out of service. The attached spreadsheet shows the required
flows by construction phase and the pumping capacity of each well. The new well will
allow for one of the wells to be a backup (system redundancy) ensuring the system can
operate sufficiently during downtime or repairs.
• Response 5: Spreadsheet attached, labeled 'Pepperwood Crossing Water System
Capacity'.
• Response 6: J&L Holdings is partially owned by Jim Bernard, who also serves as the
owner of Rocky Mountain Utility Co., Inc. (RMUC). Jim Bernard is currently in the
process of transferring the relevant water rights to Rocky Mountain Utility Co., Inc. We
can provide proof of this transfer when a document becomes available if that works for
your office.
