On May 24, 2024, the Commission issued Order No. 36195, commencing proceedings for a formal investigation into Dry Creek’s status as an unregulated water company. 3. On June 12, 2024, Staff filed comments, recommending regulation. 4. On June 25, 2024, Dry Creek moved to amend Order 36195 to extend the deadline for Dry Creek’s reply comments. While that motion was pending, Dry Creek filed preliminary reply comments asserting regulation was not appropriate. 5. The Commission granted Dry Creek’s June 25, 2024 motion to extend the reply comment deadline. Thereafter, the Commission granted Dry Creek’s request to extend its reply comment deadline to September 22, 2024 to accommodate ongoing settlement discussions between Dry Creek and Staff. Staff did not object to Dry Creek’s request. 6. Over the past few months, the Parties and their respective counsel conducted settlement discussions in writing, telephonically, and during in-person conferences at the Commission’s offices. Additionally, the Parties met at Dry Creek’s office headquarters so that a Staff member could review additional financial records as requested by Staff. 7. Based on those settlement discussions, the Parties have agreed to resolve and settle all issues in the case according to the terms set forth in the signed Settlement, attached hereto as Exhibit A. 8. The Parties agree that the Settlement represents a reasonable compromise of their respective positions in the proceeding and recommend the Commission grant this Petition and approve the Settlement in its entirety, without material changes, pursuant to IDAPA 31.01.01.274. 23rd /s/ Valerie R.
