Comes now,Aspen Creek Water Co., Inc. ( ," Creek"},pursuant to 61-526 Idaho

Code, petitions the Idaho Public Utilities Commission("Commission') for an amendment to its
Certificate of Convenience and Necessity No. 403 by enlarging and extending the boundary of
the area in which it is authorized to provide service.
We are requesting an expedited review due to a customer in need of water service to their
home that is currently outside our certificated area.
Aspen Creek provides water service to the Aspen Creek Meadows and Aspen Creek
Estates subdivisions located in Bear Lake County Idaho. The Company currently serves 73
connections with the current potential of serving 135 connections.
The area proposed to be served by this Application is adjacent to Aspen Creek's existing
certificated area. Exhibit A shows the current area serviced as outlined in yellow and the
proposed expansion area outlined in red.
Service to the amended service area will be provided through water mains and service
lines paid for by either the Company or a contractual agreement between customers and
developer(s).

Aspen Creek has received authorization from Idaho Department of Environmental
Quality to upgrade and expand its water system. Exhibit B. Aspen Creek as an adequate source
of supply to provide service to the amended service area in a safe and reliable manner.

Aspen Creek submits that the extension of its facilities to serve the amended service area
is consistent with the public convenience and necessity.

Subject: Approved for Construction —Stockyard Subdivision (Aspen Creek Meadows)
Dear Mr. McKinnon:
The Idaho Department of Environmental Quality (DEQ) has completed a review for the plans and
specifications entitled Stockyard Subdivision, dated April 12, 2024, and prepared by Dan Turner, P.E.
This project generally includes drinking water and wastewater mains and services. We have reviewed
the plans and specifications and determined that they appear to meet DEQ rules'.The drinking water
portion of the plans is approved based on the conditions listed below:
I. Project Specific Conditions:
A. Wastewater Main and Connections—This approval is for the drinking water portion of the
subdivision only.The wastewater main and connections are not approved for
construction. Fish Haven currently has a moratorium on wastewater connections due to
limited capacity and cannot treat any additional connections. Prior to construction of the
wastewater system, wastewater plans and specifications and a will serve letter must be
provided, reviewed and approved by DEQ.
ll. Standard Conditions:
A. DEQ's construction approval expires after one calendar year from the date of this letter.
For construction to proceed beyond this date, an extension request or new plans and
specifications must be submitted to DEQ for review and approval before construction may
proceed.

B. Any material deviations from the approved plans and specifications must be reviewed and
approved by DEQ before construction.
C. The owner is required to maintain one copy of the approved plans and specifications and
this DEQ approval Ietter on-site during construction at all times.The owner must ensure

that the contractor, construction inspector,and certifying engineer are aware of the
approval conditions. -
D. Construction must be inspected by an Idahp-licensed Professional Engineer, or designee,
to the extent required to confirm material compliance with approved plans. An Idaho
licensed Professional Engineer representing the system must submit record drawings,or a
statement of material compliance,to DEQ within 30 days after construction completion.
E. This approval pertains only to drinking water and wastewater infrastructure and does not
relieve the owner, engineer, or the contractor of the responsibility to comply with ail
current applicable federal, state, and local laws, rules, regulations,or ordinances.
