On July 23, 2024, Dry Creek Water Company, LLC ("Company") filed an expedited
motion to extend the then-existing reply comment deadline of July 24, 2024, by 60 days, with a
check-in with Staff occurring within 30 days ("Motion"). The Company represented that this
extension would provide it sufficient time to take steps to resolve this matter via settlement or
stipulation and to submit evidence to Staff that those steps have been completed. Staff did not
oppose the proposed extension.
The Commission initially considered the Company's motion during the July 23, 2024,
decision meeting. However, the Commission did not immediately rule on the Motion, holding it
in abeyance and providing the Company with ten days to file additional information describing the
specific steps being taken to resolve this case. Order No. 36278. Additionally, the Commission
vacated the July 24, 2024, deadline for the Company to file supplemental reply comments
resetting it to August 16, 2024, to provide the Company time to make the supplemental filing.
Subsequently, the Company timely filed a memorandum and confidential declaration from a
Company employee further describing the Company's efforts to resolve this case. Staff then
presented a decision memorandum that indicated it still did not oppose the Company's Motion.
The Commission took up the Company's Motion again during its August 6, 2024, decision
meeting. Based upon the information the Company provided,the Commission found it reasonable
to grant the Company's requested extension.Accordingly,we issue this Order vacating the existing
reply comment deadline and reset it for September 22, 2024, and directing the Company to update
Staff in writing on the status of its efforts to resolve this case no later than August 23, 2024.
COMMISSION FINDINGS AND DECISION
The Company seeks procedural relief in the form of a 60-day extension measured from the
prior July 24, 2024,reply comment deadline with a requirement that the Company update Staff on
its efforts to resolve the issue in this case within 30 days. Staff(the only other party to this case)
has indicated it does not oppose the extension.

We previously granted the Company's request to extend the original reply comment
deadline of June 26, 2024, by 28 days to July 24, 2024. Order No. 36268. To facilitate the
submission of additional information from the Company, we again reset the reply comment
deadline to August 16,2024.Order No.36278.Based on the information provided by the Company
and Staff s non-opposition, we find it reasonable to grant the Company's request for additional
time to coordinate with its financial partners and pursue avenues to resolve this case via stipulation
or settlement. Therefore, we vacate the August 16, 2024, reply comment deadline and grant the
Company's request for an additional 60 days from the prior reply comment deadline of July 24,
2024, to file reply comments.
However, as we have previously extended the reply comment deadline in this case,we find
it reasonable to require the Company to update Staff on the progress of its efforts to resolve this
case prior to the reply comment deadline. Accordingly, we direct the Company to update Staff in
writing on the status of its efforts to resolve this case no later than August 23, 2024.
ORDER
IT IS HEREBY ORDERED that the Company's request to amend Order No. 36268 is
granted.
IT IS FURTHER ORDERED that the August 16, 2024, reply comment deadline
established in Order No. 36278, is vacated and reset for September 22, 2024.
IT IS FURTHER ORDERED that the Company shall update Staff in writing on the status
of its efforts to resolve this case no later than August 23, 2024.
