HomeMy WebLinkAbout20230625Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER LODGE COMMISSIONER HAMMOND COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: STEPHEN GOODSON,POLICY ADVISOR DATE: JUNE 25,2023 SUBJECT: ZERO BASED RULES REVIEW-2024 BACKGROUND Executive Order 2020-01, signed by Governor Little sets forth a Zero-Based Rule Review for all state agencies. A master schedule was created for agencies with specific sets of IDAPA rules to be reviewed over a five-year period. This year's rules for review are IDAPA: • 31.41.01,Customer Relations Rules for Telephone Corporations Providing Services in Idaho Subject to Customer Service Regulation by the Idaho Public Utilities Commission(The Telephone Customer Relations Rules) • 31.46.01,Universal Service Fund Rules (USF) • 31.46.02,Rules for Telecommunications Relay Services (TRSj • 31.21.01,Customer Relations Rules for Gas,Electric, and Water Public Utilities (the Utility Customer Relations Rulesj Durning the 2024 Legislative Session, House Bill 563 passed and was signed into Law.HB563 requires agencies,when a chapter is up for review,to develop a report for the rule's necessity, and whether the rule should be moved into statue. STAFF RECOMMENDATIONS Upon review, Staff recommends the Commission direct Staff to submit the necessary forms to publish a Notice of Proposed Rulemaking in the Administrative Bulletin for the two Customer Relation Rules. Staff also recommends the Commission move the TRS and USF Rules into statue. COMMISSION DECISION Does the Commission wish to approve Staff s recommendations?
