BILLING PRACTICES ) NOTICE OF EXTENSION
ORDER NO. 36276
During Staff s routine audit of Aspen Creek Water Company("Company") Staff observed
several instances of the Company charging for connections and rates in excess of the amounts
permitted by its Commission-approved tariff.
On May 29, 2024, the Commission issued a Notice of Investigation directing Staff to file
a report by July 10, 2024. Order No. 36196.
On July 9, 2024, at the Commission's Decision Meeting, Staff presented a Decision
Memorandum indicating it had found additional areas of concern related to the Company's
Certificate of Public Convenience and Necessity ("CPCN") that it hoped to investigate during its
investigation into the Company's billing practices as authorized by Order No. 36196. Staff
requested additional time to complete the investigation into the Company's billing practices and
CPCN.
We now issue this Notice of Extension granting Staff until September 6, 2024, to file its
report. Further,we remind the Company that it may only charge its customers for service based on
the rates contained in its Commission approved tariff.
ORDER
IT IS HEREBY ORDERED that Staff must file its report on its investigation into the
Company's billing practices and CPCN by September 6, 2024.
IT IS FURTHER ORDERED that the Company is directed to produce necessary
documents, including a map and sufficient legal description, of its certificated area to Staff within
30 days of the publication of this Order.
IT IS FURTHER ORDERED that the Company is directed to charge its customers only
the rates and fees approved by this Commission.
IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21,
2022. Generally, all pleadings should be filed with the Commission electronically and will be
deemed timely filed when received by the Commission Secretary.See Rule 14.02. Service between

parties should continue to be accomplished electronically when possible. However, voluminous
discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
