VEO-W-23-05 AND VEOLIA WATER IDAHO'S JOINT ) APPLICATION TO AMEND VEOLIA ) ORDER NO. 36258 WATER IDAHO'S CERTIFICATE OF ) PUBLIC CONVENIENCE AND NECESSITY ) On December 28, 2023, the City of Eagle and Veolia Water Idaho, Inc. ("Company") (collectively the "Applicants")jointly applied to amend and revise the Company's Certificate of Public Convenience and Necessity("CPCN")No. 143 to remove a portion of service area covering the City from the Company's certificated service territory ("Area 4"). The Applicants requested their Application be processed via modified procedure. On May 31, 2024, the Commission issued Order No. 36200, approving the Applicants' request to remove Area 4 from the Company's CPCN No. 143. The Order also approved the transfer and accounting treatment of certain assets identified in the Application. Additionally, the Company was directed to submit an amended CPCN No. 143 with Area 4 removed from the Company's service territory within 15 days. On Jun 13, 2024,the Company submitted a revised CPCN No. 143 as a compliance filing. Commission Staff reviewed the filing and, at the Commission's July 2, 2024, decision meeting, recommended that the Commission accept the filing. COMMISSION FINDINGS AND DECISION Having reviewed the record and the Company's submission,the Commission finds that the Company has complied with Order No. 36200. ORDER IT IS HEREBY ORDERED that the Company's amended CPCN No. 143 is approved as filed. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date upon this Order regarding any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. Idaho Code §§ 61-626.
