HomeMy WebLinkAbout20240709Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: DAYN HARDIE DEPUTY ATTORNEY GENERAL DATE: JULY 10, 2024 SUBJECT: IN THE MATTER OF THE INVESTIGATION INTO ASPEN CREEK WATER COMPANY'S BILLING PRACTICES; CASE NO.ASP-W-24-01. During Staff s routine audit of Aspen Creek Water Company("Company") Staff observed several instances of the Company charging for connections outside of the amount permitted by its Commission-approve tariff. Currently the tariff permits the Company to charge $1,000 for new connections. In Staffs cursory review, several customers were charged $5,000 to connect. Staff also observed the Company charging rates for water service outside those permitted by the tariff. On May 29, 2024, the Commission issued a Notice of Investigation directing Staff to file a report by July 10, 2024. Order No. 36196. Staff has been investigating the Company's billing practices as directed by Order No. 36196.During its investigation into the Company's billing practices,which the Company has been cooperating with, Staff has found additional areas of concern with the Company's Certificate of Public Convenience and Necessity("CPCN"), specifically the area covered by its CPCN. STAFF RECOMMENDATION Staff recommends the Commission issue an order granting until September 6, 2024, to investigate the Company's billing practices and file its report. Staff also recommends the Commission direct the Company to file a map and description of its certificated area within 30 days of the issuance of the order.
