HomeMy WebLinkAbout20240702Decision Memo.pdf DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: YAO YIN ADAM TRIPLETT,DEPUTY ATTORNEY GENERAL DATE: JULY 252024 RE: IN THE MATTER OF IDAHO POWER COMPANY'S APPLICATION FOR APPROVAL OF A POWER PURCHASE AGREEMENT WITH PVS 2,LLC; CASE NO. IPC-E-24-01. On October 12,2023,the Idaho Public Utilities Commission("Commission")issued Order No. 35958 in Case No. IPC-E-21-42 approving (1) Schedule 33, which is where all renewable projects serving Brisbie, LLC's load are documented; and (2) the Renewable Capacity Credit Payment Structure for Pleasant Valley Solar, which described how monthly adjusted Renewable Capacity Credits ("RCC")will be calculated for Pleasant Valley Solar 1 ("PVS 1"). On May 28, 2024, the Commission issued Order No. 36197 in this case, approving the Power Purchase Agreement ("PPA") between Idaho Power Company ("Company") and Pleasant Valley Solar 2 ("PVS 2"), LLC. On June 18, 2024, the Company submitted a Compliance Filing (1) to update Schedule 33 to include the parameters necessary to calculate RCC payments of PVS 2 generation to Brisbie; and (2) to provide the RCC payment structure necessary to calculate monthly adjusted RCC payments for PVS 2 included as Attachment 2-Renewable Capacity Credit Payment Structure for Pleasant Valley Solar 2 in the Compliance Filing. STAFF ANALYSIS Staff reviewed the updates for Schedule 33 that reflect parameters of PVS 2 necessary to calculate the RCC payments to Brisbie for PVS 2 generation and the payment structure documented in Attachment 2 of the Compliance Filing. Staff believes that the parameters included DECISION MEMORANDUM 1 in Schedule 33 are correct and that the method used to describe how monthly adjusted RCC will be calculated for PVS 2 is consistent with the method approved for PVS 1 in Order No. 35958. STAFF RECOMMENDATION Staff recommends the Commission approve the updates for Schedule 33 and the Renewable Capacity Credit Payment Structure for Pleasant Valley Solar 2 contained in the Company's Compliance Filing.
