IPC-E-24-11 DETERMINATION OF 2023 DEMAND-SIDE ) MANAGEMENT EXPENSES AS ) PRUDENTLY INCURRED ) ORDER NO. 36177 On May 1, 2024, the NW Energy Coalition("NWEC") and the South Central Community Action Partnership ("SCCAP") (jointly, "NWEC/SCCAP") moved the Idaho Public Utilities Commission ("Commission"), under Commission Rule of Procedure 43.031 and Idaho Bar Commission Rule ("IBCR") 227, for an Order approving the limited admission, pro hac vice, of F. Diego Rivas in this matter. The Motion was signed and attested to by local counsel Benjamin J. Otto of Boise, Idaho (Idaho State Bar License No. 8292). In the Motion, Mr. Rivas certifies that he is an active member in good standing of the Montana State Bar who maintains the regular practice of law in Montana. He further declares that he is not an Idaho resident or currently licensed to practice law in Idaho. Mr.Otto and Mr.Rivas certify that a copy of the Motion has been served on all other parties to this case, and that a copy of the Motion, accompanied by a $325 fee and certificate of good standing, have been submitted to the Idaho State Bar. Mr. Otto acknowledges that his attendance shall be required at all Commission proceedings in which Mr. Rivas appears, unless specifically excused by the Commission. COMMISSION FINDINGS The Commission has reviewed and considered the Motion and applicable rules, including IBCR 227 and Commission Rules of Procedure 19 and 43.03, IDAPA 31.01.01.019 and 043.03. Based on the filings of record and certified representations of Mr. Otto and Mr. Rivas,we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Mr. Rivas as legal counsel for NWEC/SCCAP in this matter. We further find good reason to excuse 1 Commission Rule of Procedure 19 also pertains to motions for pro hac vice admission. ORDER NO. 1 the appearance of Mr. Otto from appearing on behalf of NWEC/SCCAP in this docket unless otherwise required by the Commission or needed by Mr. Rivas. CONCLUSIONS OF LAW The Commission has jurisdiction in this case and over this Motion pursuant to Idaho Code, Title 61, and the Commission's Rules of Procedure, 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Motion is granted, F. Diego Rivas is hereby granted limited admission as legal counsel for NWEC/SCCAP. IT IS FURTHER ORDERED that the attendance of Benjamin J. Otto is excused from appearing on behalf of NWEC/SCCAP in this matter unless otherwise required by the Commission or needed by F. Diego Rivas.
